LOCAL AUTHORITIES (TRAFFIC WARDENS) ACT, 1975. (DISPOSAL OF MONEYS) REGULATIONS, 1975.

The Minister for Local Government in exercise of the powers conferred on him by subsection (8) of section 3 and section 6 of the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975) hereby makes the following Regulations:—

1. These Regulations may be cited as the Local Authorities (Traffic Wardens) Act, 1975 (Disposal of Moneys) Regulations, 1975.

2. In these Regulations "the Act" means the Local Authorities (Traffic Wardens) Act, 1975 .

3. Moneys accruing to a local authority in any period of a year ending on 31st December under section 3 of the Act shall be lodged to the county or municipal fund as may be appropriate and shall be applied—

( a ) towards the payment of the costs incurred in that period of a year of operating the provisions of the Act, and

( b ) after the payment referred to in paragraph (a), by being transferred as capital money to the capital account of the local authority and by being then applied with the approval of the Minister for Local Government for the provision or extension of parking facilities, road improvements, traffic controls or other similar traffic improvements or for the purposes specified in section 101 of the Road Traffic Act, 1961 (No. 24 of 1961) as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968).

EXPLANATORY NOTE.

These Regulations provide for the disposal of moneys received by local authorities under section 3 of the Local Authorities (Traffic Wardens) Act, 1975 .
