: ROAD TRAFFIC ACT, 1961 (SECTION 103) (OFFENCES) (AMENDMENT) REGULATIONS, 1975.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 103 of the Road Traffic Act, 1961 (No. 24 of 1961), as amended by sections 6 and 64 of the Road Traffic Act, 1968 (No. 25 of 1968), hereby makes the following Regulations:—

1. These Regulations may be cited as the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1975.

2. In these Regulations—

"the Act" means the Road Traffic Act, 1961 ;

"the Principal Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1962 ( S.I. No. 91 of 1962 ).

3. There shall be substituted for article 5 of the Principal Regulations the following article:—

"5. The prescribed amounts for the purposes of paragraph (b) of sub-section (2) and of paragraph (b) of subsection (3) of section 103 of the Act for offences declared by the Minister to be offences to which that section applies shall be

( a ) three pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under sections 89 or 90 of the Act, and

( b ) two pounds in respect of all other offences."

4. The form prescribed by article 4 of the Principal Regulations shall be amended by the insertion after the words "two pounds" of "or three pounds*" and by the addition under the heading "Directions for completing this form" of "*Omit whichever is inappropriate".

5. These Regulations shall come into operation on the 1st day of September, 1975.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1962 ( S.I. No. 91 of 1962 ) by increasing the amount from £2 to £3 for an offence on a clearway as the amount which a person liable to prosecution for an offence to which section 103 applies, may pay as an alternative to the institution of a prosecution.
