S.I. No. 116/1975 - European Communities (Surveillance of Certain Clothing and Footwear Imports) Regulations, 1975.


WHEREAS the State has been authorised under the Decisions of the Commission of the European Economic Communities dated 12th May, 1971 (No. 71/202/EEC) and 9th March, 1973 (No. 73/55/EEC) to take protective measures hereinafter specified (the conditions and details of which the Commission has determined under those Decisions):

I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the power conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Surveillance of Certain Clothing and Footwear Imports) Regulations, 1975, and shall come into operation on the 12th day of June, 1975.

2. (1) In these Regulations "the Minister" means the Minister for Industry and Commerce.

(2) A reference in these Regulations to a tariff heading number shall be taken to be a reference to that tariff heading number in the Imposition of Duties (No. 200) (Customs and Excise Duties and Form of Tariff) Order, 1972 ( S.I. No. 220 of 1972 ).

3. (1) These Regulations apply to the goods specified at a tariff heading number mentioned in column (1) of the Schedule to these Regulations, but do not apply to goods which:—

( a ) form part of a parcel being imported by parcel post, the value of which does not exceed £25, or

( b ) are shown to the satisfaction of the Revenue Commissioners to be designed, constructed and intended solely for use for scientific, medical or surgical purposes, or

( c ) are shown to the satisfaction of the Revenue Commissioners to be blanketing or felt being imported solely for use in an industrial process other than the manufacture of saddlery, harness, blankets, rugs, personal clothing or wearing apparel.

(2) The particulars stated in column (2) of the Schedule to these Regulations are inserted solely to facilitate identification of the goods referred to at the tariff heading number mentioned in column (1) of that Schedule opposite the insertion in column (2), and, accordingly, nothing contained in column (2) shall affect the construction or limit or control the operation of any provision of these Regulations (including the mention of the tariff heading number in column (1)).

(4) The importation into the State of any goods to which these Regulations apply shall be subject to the production by the importer of an import authorisation issued by the Minister for Industry and Commerce.

EXPLANATORY NOTE.

The effect of the Instrument is to enable the Minister for Industry and Commerce to impose a system of surveillance on imports into Ireland of Certain Clothing and Footwear.
