PRICES AND CHARGES (NOTIFICATION OF INCREASES) ORDER, 1975.

I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by sections 22A and 22C (inserted by the Prices (Amendment) Act, 1965 (No. 23 of 1965)) of the Prices Act, 1958 (No. 4 of 1958) as amended by the Prices (Amendment) Act, 1972 (No. 20 of 1972), and the Prices Stabilisation Order, 1973 ( S.I. No. 96 of 1973 ), hereby order as follows:

1. This Order may be cited as the Prices and Charges (Notification of Increases) Order, 1975.

2. This Order shall come into operation on the 31st day of January, 1975.

3( a ) Any person—

(i) who is engaged in the sale of a commodity imported by him or in the sale by wholesale of a commodity not manufactured by him,

(ii) who proposes to increase the amount by which the price at which he sells the commodity exceeds the price at which he buys the commodity, and

(iii) whose business had a turnover of more than £250,000 in its latest financial year before the date on which the increase takes effect,

shall notify the Minister of the increase.

( b ) Any person who is engaged in the sale of a commodity manufactured by him, the rendering of a service or the carrying out (other than under a contract of service) of work or a process shall notify the Minister of any increase he proposes to make in the price at which he sells the commodity or the charge which he makes for rendering the service or carrying out the work or process, as the case may be.

4( a ) A notification under paragraph 3 of this Order shall be given to the Minister not later than two months before the day on which the increase to which it relates takes effect.

( b ) A notification given before the 31st day of January, 1975, in respect of any of the matters mentioned in subparagraph (b) of the said paragraph 3 shall be deemed, for the purposes of this paragraph, to be a notification in respect of those matters under the said subparagraph (b).

5. The Prices and Charges (Notification of Increases) Order, 1973 ( S.I. No. 98 of 1973 ) and the Prices (Stabilisation of Profit Margins of Importers and Wholesalers) Order, 1973 ( S.I. No. 167 of 1973 ) are hereby revoked.

EXPLANATORY NOTE.

This Order provides that a manufacturer may not increase the price of a commodity manufactured by him, and that a person rendering a service or carrying out (other than under a contract of service) work or a process may not increase his charge without giving two month's notice in advance to the Minister for Industry and Commerce. The Order further provides that an importer or a wholesaler whose business had a turnover of more than £250,000 in its latest financial year may not increase the actual cash margin he takes on any commodity in which he deals without giving two month's notice in advance to the Minister.
