ROAD TRAFFIC (PUBLIC SERVICE VEHICLES) (AMENDMENT) REGULATIONS, 1974.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 82 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations :—

1. (1) These Regulations may be cited as the Road Traffic (Public Service Vehicles) (Amendment) Regulations, 1974.

(2) These Regulations and the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1973, shall be construed together as one regulation and may be cited together as the Road Traffic (Public Service Vehicles) Regulations, 1963 to 1974.

(3) In these Regulations "the Principal Regulations" means the Road Traffic (Public Service Vehicles) Regulations, 1963 ( S.I. No. 191 of 1963 ).

2. Article 14 of the Principal Regulations as amended by article 2 of the Road Traffic (Public Service Vehicles) (Amendment) Regulations, 1967 ( S.I. No. 274 of 1967 ) is hereby amended by the substitution for sub-article (1) of the following sub-article:—

"(1) A large public service vehicle having passenger accommodation for more than fourteen passengers shall not be used as an omnibus unless—

( a ) there is carried on the vehicle a conductor who acts as the conductor of the vehicle, or

( b ) the vehicle is a single-deck vehicle every entrance and exit ( other than an emergency exit) of which is fitted with a power-operated door under the effective control and supervision of the driver, or

( c ) the vehicle is of a class or is used in circumstances certified by the Commissioner (or any officer of the Garda Síochána authorised by the Commissioner in that behalf) to warrant the use of the vehicle as an omnibus without the carriage of a conductor thereon, or

( d ) the vehicle is a single-deck vehicle and is for the time being used exclusively for the carriage of passengers who are children, or children and teachers, going to or coming from school or school-related physical education activities".

3. Article 60 of the Principal Regulations is hereby amended by the addition thereto of the following sub-article—

"(5) In this article the expression "the carriage of children for reward to and from school " shall include the carriage for reward of children, or children and teachers, to and from school or to and from school-related physical education activities".

EXPLANATORY NOTE.

The effect of these regulations is to extend the scope of the system of licensing of school transport so as to include school-related physical activities, and the carriage of a combination of school-children and teachers.
