S.I. No. 253/1974 - Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1975 (Confirmation) Order, 1974.


WHEREAS by section 6 of the Great Southern Railways Company (Superannuation Scheme) Act, 1947 (No. 21 of 1947), the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (in these Recitals referred to as the Scheme) (a copy whereof is set out in the Schedule to that Act) was confirmed and given the force of law:

AND WHEREAS Córas Iompair Éireann (in these Recitals referred to as the Board) has, in pursuance of Rule 54 (1) of the Scheme and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), submitted to the Minister for Transport and Power a scheme (in these Recitals referred to as the amending Scheme) amending the Scheme:

AND WHEREAS the amending scheme was, under Rule 54 (2) of the Scheme referred back to the Board by the said Minister for re-consideration and re-submission:

AND WHEREAS the amending scheme was re-considered and re-submitted to the said Minister by the Board:

AND WHEREAS the said Minister, having heard all parties desirous of being heard and appearing to him to be interested in the amending scheme, proposes to confirm the amending scheme as re-considered and re-submitted to him by the Board:

NOW, I, PETER BARRY, Minister for Transport and Power, in exercise of the powers conferred on me by Rule 54 (2) of the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme, and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and by virtue of the operation of section 45 of the Transport Act, 1950 (No. 12 of 1950), hereby order as follows:

1. This Order may be cited as the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1973 (Confirmation) Order, 1974.

2. The Scheme (amending the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme) submitted by Córas Iompair Éireann under Rule 45 (1) of the said Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme, as modified by the Minister for Transport and Power (a copy whereof, as so modified, is set out in the Schedule to this Order), is hereby confirmed, and shall be deemed to have come into operation on the 1st day of January, 1971.

SCHEDULE

CÓRAS IOMPAIR ÉIREANN, SALARIED OFFICERS' AND CLERKS' (G.S.R.) SUPERANNUATION SCHEME AMENDING SCHEME, 1973.

1. Interpretation

In this amending Scheme the following words and expressions shall have the meanings hereby assigned to them unless there is something inconsistent in the subject matter or the context repugnant to such construction:—

"the existing Scheme" means the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme as scheduled to the Great Southern Railways Company (Superannuation Scheme) Act, 1947 (No. 21 of 1947) and amended by the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1962 (Confirmation) Order, 1963 ( S.I. No. 220 of 1963 ) and the Córas Iompair Éireann, Salaried Officers' and Clerks' (G.S.R.) Superannuation Scheme (Amendment) Scheme, 1968 (Confirmation) Order, 1971 ( S.I. No. 76 of 1971 ).

"This Scheme" means the existing Scheme as hereby amended.

"Operative date" means the first day of January, 1971.

2. In this Amending Scheme unless otherwise expressly stated words and expressions used shall have the meanings assigned to them by the existing Scheme.

3. Continuance of the existing Scheme

(1) The benefits provided by the existing Scheme shall continue to be paid or to be payable under and in accordance with the terms thereof and without alteration to every existing pensioner whose right to pension accrued prior to the operative date and the personal representative of any deceased pensioner if the deceased's right to pension accrued prior to the operative date.

(2) ( a ) Nothing in this amending Scheme shall affect the rights of any of the persons mentioned in the preceding sub-article nor shall this amending Scheme affect any subsisting right or liability accrued to or incurred by any person under the existing Scheme prior to the operative date.

( b ) Deferred pensions now payable or at any time to become payable shall not be affected by this amending Scheme.

4. Amendment of the existing Scheme

Subject to the provisions of Article 3 of this amending Scheme the existing Scheme shall be amended with effect on and from the operative date so as to conform to the provisions hereinafter contained and every provision of the existing Scheme which is inconsistent with the provision hereinafter contained shall cease to have effect.

5. Application of the Scheme to Female Members

Subparagraph (b) of paragraph (5) of Rule 10 shall be deleted and the following subparagraph substituted therefor:—

"(b) for the table contained in Rule 16, there shall be substituted the table set forth in Rule 25:"

6. Contributions

Rule 11 of the existing Scheme shall be amended by the deletion of paragraph (1) and the substitution of the following paragraph:—

"(1) Every contributing member shall contribute a sum equal to such percentage of his salary as is provided for in the following scales:—

( a ) for each pre-1941 member:—

Rule 11 shall be further amended by the deletion of paragraph (3) of the existing Scheme and the substitution of the following paragraph:—

"(3) The Board shall contribute to the Fund sums which in the case of each male member shall equal the amount contributed by the member plus an additional 2% of the member's salary and in the case of each female member shall equal the amount contributed by the member plus an additional half of one per cent of her salary and the Board shall pay every such contribution to the Fund at such times as the members make their contributions in accordance with the directions of the Trustees.

EXPLANATORY NOTE.

The purpose of this order is to provide for an increase in the contributions of C.I.E. and members of the Superannuation Scheme Fund.
