SOCIAL WELFARE (OLD AGE AND WIDOWS' AND ORPHANS' (CONTRIBUTORY) PENSIONS, RETIREMENT PENSION AND DESERTED WIFE'S BENEFIT) (AMENDMENT) REGULATIONS, 1974.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) section 28A of the said Act (inserted therein by section 10 of the Social Welfare (Amendment) Act, 1960 (No. 25 of 1960) and amended by section 6 of the Social Welfare (Miscellaneous Provisions) Act, 1966 (No. 24 of 1966)) section 28B of the said Act (inserted therein by section 10 of the Social Welfare Act, 1970 (No. 12 of 1970)) and section 28C of the said Act (inserted therein by section 17 of the Social Welfare Act, 1973 (No. 10 of 1973)), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Old Age and Widows' and Orphans' (Contributory) Pensions, Retirement Pension and Deserted Wife's Benefit) (Amendment) Regulations, 1974.

2. Articles 3 and 4 of these Regulations shall come into operation on the 5th day of July, 1974 and articles 5 and 6 on the 4th day of July, 1974.

3. The following Schedule shall be substituted for the Schedule to the Social Welfare (Old Age (Contributory) Pension) Regulations, 1960 ( S.I. No. 274 of 1960 ).

Reduced rates of old age (contributory) pensions where contribution conditions are partially satisfied.

6. (1) The following definition shall be substituted for the definition of "relevant period" in article 2 of the Social Welfare (Deserted Wife's Benefit) Regulations, 1973 ( S.I. No. 202 of 1973 )—

"relevant period" means the period over which the yearly average of contributions per contribution year is calculated for deserted wife's benefit purposes in accordance with paragraph 10 (b) (ii) of the Fourth Schedule to the Act of 1952, and

(2) The following Schedule shall be substituted for the Schedule to the Social Welfare (Deserted Wife's Benefit) Regulations, 1973.

EXPLANATORY NOTE.

The Social Welfare (No. 2) Act, 1974 provides, inter alia, for increases in the maximum rates of old age (contributory), widows' (contributory) and retirement pensions and deserted wife's benefit.

The effect of these Regulations is to provide for increases in the reduced rates of pensions or benefit (which were heretofore determined by virtue of the provisions of the Social Welfare (Old Age and Widows' and Orphans') (Contributory) Pensions and Retirement Pension) (Amendment) Regulations, 1973 and the Social Welfare (Deserted Wife's Benefit) Regulations, 1973) payable where the contribution conditions are partially satisfied.

The improvements take effect from 5th July, 1974 in the case of old age (contributory) and widows' (contributory) pensions and from 4th July, 1974 in the case of retirement pension and deserted wife's benefit.
