LOCAL ELECTIONS (PETITIONS AND DISQUALIFICATIONS) ACT, 1974 (SECTION 25) (NO. 2) ORDER, 1974.

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 25 (3) of the Local Elections (Petitions and Disqualifications) Act, 1974 (No. 8 of 1974), after consultation with the Minister for Local Government, hereby order as follows:

1. This Order may be cited as the Local Elections (Petitions and Disqualifications) Act, 1974 (Section 25) (No. 2) Order, 1974.

2. In this Order "the Act of 1926" means the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926).

3. The following classes, descriptions and grades of employments and offices of a Committee of Agriculture are hereby designated for the purposes of paragraph (b) of section 25 (3) of the Local Elections (Petitions and Disqualifications) Act, 1974 (No. 8 of 1974), namely,

( a ) all such employments as a servant,

( b ) all such offices other than,

(i) offices to which the Act of 1926 applies,

(ii) offices the duties of which are wholly or mainly of an administrative, executive or clerical nature and the maximum remuneration for which exceeds the maximum remuneration for the office of Clerical Officer, and

(iii) any temporary office to which the Act of 1926 would apply if the office were a permanent office.

EXPLANATORY NOTE.

The Instrument sets out the modifications made, pursuant to section 25 of the Local Elections (Petitions and Disqualifications) Act, 1974 , by the Minister for Agriculture and Fisheries after consultation with the Minister for Local Government, of restriction on holding office or being employed under committees of agriculture.
