MAXIMUM PRICES (MILK) ORDER, 1974.

I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by sections 22A and 22C (inserted by the Prices (Amendment) Act, 1965 (No. 23 of 1965)), of the Prices Act, 1958 (No. 4 of 1958), as amended by the Prices (Amendment) Act, 1972 (No. 20 of 1972), and the Prices Stabilisation Order, 1973 ( S.I. No. 96 of 1973 ), hereby order as follows:

1. This Order may be cited as the Maximum Prices (Milk) Order, 1974.

2. (1) In this Order "bottled milk" means liquid milk in any closed receptacle containing more than a half-pint in imperial measure or more than 284 millilitres in metric measure but not more than a quart in imperial measure or not more than 1.136 litres in metric measure but does not include separated milk, skim milk, buttermilk, condensed milk or cream.

(2) A certificate signed by the Public Analyst and the Chief State Chemist that milk is bottled milk within the meaning of paragraph (1) of this Article shall, without further proof of the signature of the person purporting to sign the certificate or that that person was the proper person so to sign, be prima facie evidence in any legal proceedings of the matters certified in the certificate.

3. The maximum prices at which bottled milk (other than milk described when bottled as highest grade milk) may be sold by retail shall be—

( a ) in case the milk is bottled in quantities expressed by measure in imperial measure, prices calculated at the rate of 6p per pint (568 millilitres) during the period commencing on the 1st day of April, 1974, and ending on the 30th day of June, 1974, or

( b ) in case the milk is bottled in quantities of 500 millilitres by measure in metric measure, prices calculated at the rate of—

(i) 5p per 500 millilitres during the period commencing on the 1st day of April, 1974, and ending on the 10th day of May, 1974,

(ii) 5½p per 500 millilitres during the period commencing on the 11th day of May, 1974, and ending on the 30th day of June, 1974,

and no extra charge shall be made in respect of the container in which the milk is sold.

4. The Maximum Prices (Milk) (No. 2) Order, 1973, ( S.I. No. 270 of 1973 ), is hereby revoked with effect from the 1st day of April, 1974.
