SOCIAL WELFARE (PRESCRIBED RELATIVE) (AMENDMENT) REGULATIONS, 1974.

The Minister for Social Welfare in exercise of the powers conferred on him by Section 3 of the Social Welfare Act, 1952 (No. 11 of 1952), Section 26 (4) of the said Act (inserted by Section 9 of the Social Welfare (Miscellaneous Provisions) Act, 1968 (No. 31 of 1968), and Section 77 (5) of the said Act (inserted by Section 16 of the Social Welfare (Miscellaneous Provisions) Act, 1969 ), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Prescribed Relative) (Amendment) Regulations, 1974.

(2) These Regulations and the Social Welfare (Prescribed Relative) Regulations, 1972 and 1973, may be cited together as the Social Welfare (Prescribed Relative) Regulations, 1972 to 1974.

2. Article 5 of the Social Welfare (Prescribed Relative) Regulations, 1972 ( S.I. No. 248 of 1972 ) is hereby amended by the insertion after "son-in-law," of "a brother-in-law," and after "daughter-in-law" of ",a sister-in-law".

EXPLANATORY NOTE.

Sections 9 and 10 of the Social Welfare (Miscellaneous Provisions) Act, 1968 (No. 31 of 1968) provide, subject to certain conditions, for an increase of the pension of a person who is incapacitated and in receipt of an old age pension, either contributory or non-contributory, or, having reached pensionable age, a widow's contributory pension and with whom a prescribed relative resides for the purpose of providing full-time care and attention. Section 13 of the Social Welfare Act, 1972 (No. 15 of 1972) provides for such an increase in the case of a recipient of invalidity or retirement pension who has reached pensionable age.

The Social Welfare (Prescribed Relative) Regulations, 1972 ( S.I. No. 248 of 1972 ) specify the following to be prescribed relatives viz., a brother, a half-brother, a son, a step-son, a grand-son, a son-in-law, a nephew, a sister, a half-sister, a daughter, a step-daughter, a grand-daughter, a daughter-in-law and a niece.

These regulations add a brother-in-law and a sister-in-law to the above categories of prescribed relatives.
