BROADCASTING (RECEIVING LICENCES) (AMENDMENT) REGULATIONS, 1973.

I, CONOR CRUISE-O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), as amended by the Wireless Telegraphy Act, 1956 (No. 4 of 1956), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Broadcasting (Receiving Licences) (Amendment) Regulations, 1973.

(2) The Broadcasting (Receiving Licences) Regulations, 1961 to 1972, and these Regulations may be cited together as the Broadcasting (Receiving Licences) Regulations, 1961 to 1973.

(3) These Regulations shall come into effect on the 1st day of October, 1973.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

"the Principal Regulations" means the Broadcasting (Receiving Licences) Regulations, 1961 ( S.I. No. 279 of 1961 );

"the Regulations of 1971" means the Broadcasting (Receiving Licences) (Amendment) Regulations, 1971 ( S.I. No. 241 of 1971 ).

4. The Principal Regulations are hereby amended by—

( a ) the substitution of the following regulation for Regulation 5:

"5. (1) Every receiving licence in respect of apparatus for receiving sound and visual images, in colour and monochrome or in colour only, broadcast by a broadcasting station shall be in the form set out in the First Schedule hereto.

(2) Every receiving licence in respect of apparatus for receiving sound and visual images, in monochrome only, broadcast by a broadcasting station shall be in the form set out in the Second Schedule hereto.";

( b ) the substitution of the following paragraph for paragraph (1) of Regulation 7 (inserted by Regulation 4 (c) of the Broadcasting (Receiving Licences) (Amendment) Regulations, 1972 ( S.I. No. 210 of 1972 )):

"(1) Save as is otherwise provided by this Regulation, a fee of fifteen pounds shall be paid on the grant of a receiving licence in the form set out in the First Schedule hereto, and a fee of nine pounds shall be paid on the grant of a receiving licence in the form set out in the Second Schedule hereto.";

( c ) the substitution of the following paragraphs for paragraphs (1) and (2) of Regulation 8 (inserted by Regulation 5 of the Regulations of 1971):

" (1) Every receiving licence (not being a licence granted by way of renewal) shall come into force on the day on which it was granted and shall, unless sooner revoked by the Minister under these Regulations, continue in force until the end of the eleventh month after the month in which it was granted.

(2) Every receiving licence granted by way of renewal of a previous receiving licence shall come into force at whichever of the following times is the later, that is to say, the expiration of the previous receiving licence or the grant of the renewal licence, and shall in every case, unless sooner revoked by the Minister under these Regulations, continue in force from the time at which it so commences until the end of one year from the expiration of the previous receiving licence.";

( d ) the substitution of the following regulation for Regulation 14:

" 14. (1) Where an unexpired receiving licence in respect of apparatus for the reception of sound and visual images in monochrome only which has been granted in accordance with these Regulations is surrendered on or after the grant to the licensee of a licence in the form set out in the First Schedule to these Regulations, a rebate of part of the fee paid in respect of the surrendered licence may be made to the licensee and the rebate may be credited as a payment on account of the fee specified in paragraph (1) of Regulation 7 of these Regulations in relation to licences in the form set out in the First Schedule to these Regulations.

(2) The rebate in respect of a surrendered licence mentioned in paragraph (1) of this regulation shall be calculated at the rate of—

(i) in the case of a licence for which a fee of seven pounds fifty new pence was paid, sixty-two and a half new pence,

(ii) in the case of a licence for which a fee of nine pounds was paid, seventy-five new pence,

for each complete month or part (if any) of a month for which the licence would otherwise have continued in force from the date of the surrender thereof.";

( e ) the substitution of the following for the First Schedule thereto (inserted by Regulation 7 of the Regulations of 1971);

5. Every licence granted in accordance with the Wireless (Receiving Licenses) Regulations, 1961 to 1972, which was in force immediately before the coming into effect of these Regulations, shall be deemed to have been granted in accordance with the Wireless (Receiving Licenses) Regulations, 1961 to 1973, in respect of apparatus for wireless telegraphy for the reception of sound and visual images in monochrome only.

EXPLANATORY NOTE.

The regulations increase the television (monochrome only) licence fee from £7.50 to £9 and introduce a television (colour and monochrome) licence fee of £15.
