WARBLE FLY (AMENDMENT) ORDER, 1973.

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. (1) This Order may be cited as the Warble Fly (Amendment) Order, 1973.

(2) The Principal Order and this Order may be cited together as the Warble Fly Orders, 1971 and 1973.

2. In this Order "the Principal Order" means the Warble Fly Order, 1971 ( S.I. No. 297 of 1971 ).

3. Article 2 of the Principal Order is hereby amended by the addition of "Notwithstanding the foregoing, for so long as a treatment period is current in any year this Order shall have effect subject to the following modification, namely, Article 5 (1) and Article 7 (1) hereof, as amended by Article 5 of the Warble Fly (Amendment) Order, 1973, shall apply only in relation to animals which, on the day on which the period begins, are at least twelve months of age".

4. Article 3 of the Principal Order is hereby amended by the insertion in the definition of "certificate of treatment" of "or, in the alternative where such is appropriate, issued in the current treatment period," after "last previous treatment period".

5. In both Article 5 (1) and 7 (1) of the Principal Order "outside the treatment period" is hereby revoked.

6. In accordance with the provisions of this Order—

( a ) the definition of "certificate of treatment" in Article 3 of the Principal Order shall have effect as set out in Part I of the Table hereto,

( b ) paragraph (1) of Article 5 of the Principal Order shall have effect as set out in Part II of the said Table, and

( c ) paragraph (1) of Article 7 of the Principal Order shall have effect as set out in Part III of the said Table.

TABLE

PART I

"certificate of treatment" means—

( a ) a certificate in the form of Form A in the Schedule to this Order issued since the commencement of the last previous treatment period or, in the alternative where such is appropriate, issued in the current treatment period and signed by—

(i) a veterinary surgeon (being a veterinary surgeon to whom an admission in writing to the Warble Fly Eradication Scheme has been issued by the Minister), or any person authorised by him to do so, or

(ii) the veterinary officer in charge of an Artificial Insemination Station, or any person authorised by him to do so, or

(iii) a veterinary inspector of the Minister or any person authorised by him to do so, or

( b ) any certificate deemed to be a certificate of treatment under Article 5 (2) of this Order;

PART II

5. (1) A person shall have neither in his possession nor under his charge at any time, except under a licence issued by the Minister, any animal to which this Order applies unaccompanied by a certificate of treatment or an exemption certificate relating to the animal and in case the Minister attaches conditions to the licence a person shall not move, except under a further licence granted by the Minister, the animal to which the first-mentioned licence relates out of the land or premises on which it is at the date of such licence until the conditions have been complied with.

PART III

7. (1) A person shall have neither in his possession nor under his charge at any time any animal to which this Order applies unless there has been inserted in the left ear of the animal an approved ear-tag and the identification letters or numbers borne on the ear-tag correspond with the identification letters or numbers appearing in the certificate of treatment, exemption certificate or licence, as the case may be, relating to the animal.

EXPLANATORY NOTE.

This Order amends the Warble Fly Order, 1971 to provide that :

(1) the documentation requirements of the 1971 Order apply during the period from 15th August to 15th November as well as during the period from 16th November to the following 14th August and

(2) during the period from 15th August to 15th November both dates inclusive a certificate of treatment issued either within that period or since 14th August in the previous year shall be deemed to be a valid certificate.
