S.I. No. 197/1973 - An Foras Talútais (Nomination of Members of the Council by Agricultural and Rural Organisations) Order, 1973.

The Government, in exercise of the powers conferred on them by section 5 (8) of the Agriculture (An Foras Talúntais) Act, 1958 (No. 1 of 1958), hereby order as follows

1. This Order may be cited as An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) Order, 1973.

2. In this Order—

" the Council " means the Council of An Foras Talúntais;

" the Minister " means the Minister for Agriculture and Fisheries;

" the Secretary " means the Secretary of the Department of Agriculture and Fisheries.

3. The nomination under section 5 (8) of the Agriculture (An Foras Talúntais) Act, 1958 (No. 1 of 1958), of five persons to be ordinary members of the Council shall be made by the agricultural and rural organisations specified in the Schedule to this Order.

4. The nomination mentioned in Article 3 of this Order shall be made in the manner specified in this Order.

5. Each of the organisations set out in the Schedule to this Order shall nominate one person to be an ordinary member of the Council.

6. (1) A person may be nominated under Article 5 of this Order by an organisation by sending by registered post addressed to the Secretary, so as to reach him within the time fixed for the receipt of nominations under this Article, a nomination made by that organisation in relation to that person which complies with the provisions of this Article.

(2) The following provisions shall apply in respect of a nomination:

(a) the Minister shall fix the time for the receipt of nominations and the Secretary shall inform the organisations specified in the Schedule to this Order of such time,

(b) the nomination shall be in writing signed by a person authorised in that behalf by the organisation making it,

(c) the nomination shall contain the full name, address and occupation of the person to whom it relates and the name and address of the organisation making it.

7. The following Orders are hereby revoked—

(a) An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) Order, 1958 ( S.I. No. 102 of 1958 );

(b) An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) (Amendment) Order, 1961 ( S.I. No. 98 of 1961 );

(c) An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) (Amendment) Order, 1964 ( S.I. No. 82 of 1964 );

(d) An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) (Amendment) Order, 1967 ( S.I. No. 119 of 1967 ); and

(e) An Foras Talúntais (Nomination of Members of the Council by Agricultural and Rural Organisations) (Amendment) Order, 1970 ( S.I. No. 121 of 1970 ).

EXPLANATORY NOTE.

The Order specifies the organisations named in the Schedule as organisations which shall nominate persons to be members of the Council of An Foras Talúntais in accordance with Section 5 (8) of the Agriculture (An Foras Talúntais) Act, 1958.
