DUBLIN APPOINTED STANDS (STREET SERVICE VEHICLES) TEMPORARY RULES, 1973.

I, PATRICK MALONE, Commissioner of the Garda Síochána in exercise of the powers conferred on me by section 84 of the Road Traffic Act, 1961 (No. 24 of 1961) as amended by the Road Traffic Act, 1968 (No. 25 of 1968) with the consent of the Minister for Local Government, hereby make the following temporary rules in respect of the area comprising the county borough of Dublin, the borough of Dún Laoghaire and the County of Dublin:

1. These rules may be cited as the Dublin Appointed Stands (Street Service Vehicles) Temporary Rules, 1973.

2. These rules shall come into operation on the 11th day of June, 1973.

3. These rules shall apply to the area comprising the county borough of Dublin, the borough of Dún Laoghaire and the County of Dublin.

4. In these rules:—

"building line" means in relation to a side of a street on which there is no straight line of buildings, the edge of that side of the street;

"street" means a public road;

reference to the head of an appointed stand shall be construed as referring to that end of the appointed stand from which the limits of the appointed stand are reckoned in Column (3) of the First and Second Schedules to the rules;

reference to the rear of an appointed stand shall be construed as referring to that end of the appointed stand to which the limits of the appointed stand are reckoned in column (3) of the First and Second Schedules to these rules;

reference to the order of the vehicles of an appointed stand shall be construed as referring to the order of the vehicles reckoned from the head of the appointed stand towards the rear of the appointed stand.

5. (1) In the several streets named in column (2) of the First Schedule to these rules, each of the places delimited in column (3) of that Schedule opposite the mention in the said column (2) of any such street shall be an appointed stand available, subject to these rules, for use without limitation as to time or occasion of user.

(2) In the several streets named in column (2) of the Second Schedule to these rules, each of the places delimited in column (3) of the said Schedule opposite the mention in the said column (2) of any such street shall be an appointed stand available, subject to these rules, for use on the occasions and at the times (but not on any other occasion or at any other time) stated in column (6) of the said Schedule opposite the mention in the said column (2) of such street.

6. For the purpose of these rules:—

(a) each of the appointed stands mentioned in column (2) of the Third Schedule to these rules shall be known as a main appointed stand;

(b) each of the appointed stands mentioned in column (3) of the said Third Schedule shall be known as a subsidiary appointed stand.

7. (1) For the purpose of these rules, a street service vehicle shall be deemed not to be standing for hire on an appointed stand unless the whole of the vehicle is within the limits of the appointed stand as stated in column (3) of the First or Second Schedules to these rules.

(2) Every street service vehicle standing for hire on an appointed stand shall be placed—

(a) in the position specified in column (5) of the First or Second Schedules to these rules opposite the mention of the appointed stand in column (3) of that Schedule, and

(b) in case there is no street service vehicle already on the appointed stand, at the head of the appointed stand and, in any other case, next in order to the street service vehicle already on the appointed stand, facing towards the head of the appointed stand and as near as practicable to the street service vehicle immediately in front,

and a street service vehicle shall be deemed for the purpose of these rules not to be standing for hire on the appointed stand unless placed thereon in accordance with this paragraph.

(3) Where the First or Second Schedule to these rules require a street service vehicle standing for hire on an appointed stand to be placed in single line by the kerb and parallel thereto or with the rear of the vehicle to the kerb a vehicle shall not be placed more than eighteen inches from the kerb.

8. Whenever the number of street service vehicles standing for hire on an appointed stand is equal to the number mentioned in column (4) of the First and Second Schedules to these rules opposite the mention of the appointed stand in column (3) of that Schedule, the driver of any street service vehicles not already so standing for hire shall not place that street service vehicle on that appointed stand.

9. (1) Whenever a vacancy occurs at an appointed stand by reason of the departure therefrom of a street service vehicle, the street service vehicle nearest to the space so vacated shall be moved by its driver into that space and thereupon each driver of any other street service vehicle then standing on that appointed stand shall in turn move his vehicle into the space which is next in order to him and is in the direction of the head of the appointed stand.

(2) Whenever a vacancy occurs on a main appointed stand by reason of the departure therefrom of a street service vehicle, the following provision shall have effect in addition to that contained in paragraph (1) of this rule: the driver of the street service vehicle at the head of the subsidiary appointed stand which is mentioned in column (3) of the Third Schedule to these temporary rules opposite the mention in column (2) of that Schedule of the main appointed stand shall place that street service vehicle on the main appointed stand.

10. The following provisions shall apply in respect of street service vehicles standing for hire on an appointed stand:—

(a) a street service vehicle shall not be so placed on an appointed stand that—

(i) it rests wholly or partly on a footway, or

(ii) portion of the vehicle projects over the footway so as to interfere with the free movement of pedestrians on the footway;

(b) a person shall not wash, overhaul or execute repairs to a street service vehicle while it is standing for hire on an appointed stand, except such repairs as may be necessary to enable the street service vehicle to be removed from the appointed stand;

(c) neither the driver of a street service vehicle which is standing for hire nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle;

(d) the driver of a street service vehicle which is placed on, being brought into or removed from an appointed stand shall comply with all directions given to him by a member of the Garda Síochána in relation to the placing of the street service vehicle on the appointed stand or the bringing of the street service vehicle into or the removal of the street service vehicle from the appointed stand.

11. A driver of a street service vehicle shall not stand the street service vehicle for hire otherwise than on an appointed stand and in accordance with these rules.

7.	Marino Crescent	On the west side of the roadway in the lay-by in the island from a point 15 feet north of the north-eastern corner of the electricity sub-station on the island to a point 54 feet north of the said point.	3	In single line by the kerb of the lay-by and parallel thereto facing southwards.
8.	Marino Crescent	On the east side of the roadway from a point opposite the north west corner of the transformer station in the park to a point 102 ft. north of the said point.	6	In single line by the kerb and parallel thereto facing southwards.

O'Connell Street, Lower	West, south and east of the raised paved median in the centre of the roadway between a point perpendicular to the eastern building line of Lower O'Connell Street, 35 feet south of the southern gable of No. 28 and a point perpendicular to the western building line of Lower O'Connell Street, 6 feet south of the boundary between Numbers 41 and 42.	24	In single line by the kerb of the median and parallel thereto facing north on the west side of the median, west on the south side of the median and south on the east side of the median.

14.	Charleston Road, Ranelagh	On the north side of the roadway, in lay-by, from a point 15 feet west of the south-east corner of the public convenience to a point 67 feet west of the said point.	3	In single line by the kerb of lay-by and parallel thereto facing westwards.
15.	College Green	On the northern side of the raised paved median in the centre of the roadway between a point 16 feet west of the western edge of Grattan Statue and a point 135 feet west of the western edge of Grattan Statue.	7	In single line by the kerb of the median and parallel thereto facing eastwards.
16. EXPLANATORY NOTE.

These rules:—

1. Provide stands for street service vehicles as indicated in the Schedules to these rules, and

2. Prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than on an appointed stand.
