ROAD TRAFFIC ACT, 1968 (PART V) (AMENDMENT) REGULATIONS, 1973.

The Minister for Local Government in exercise of the powers conferred on him by section 5 of the Road Traffic Act, 1961 (No. 24 of 1961) and sections 30 , 33 , 43 , 45 and 47 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic Act, 1968 (Part V) (Amendment) Regulations, 1973.

(2) The Road Traffic Act, 1968 (Part V) Regulations, 1969 and these Regulations shall be construed as one and may be cited together as the Road Traffic Act, 1968 (Part V) Regulations 1969 and 1973.

2. In these Regulations " the Principal Regulations " means the Road Traffic Act, 1968 (Part V) Regulations, 1969 ( S.I. No. 196 of 1969 ).

3. The Principal Regulations are hereby amended by—

(i) the substitution of "close" for "seal" in the definition of "stopper" in article 2 (1),

(ii) the addition of the following sub-paragraph to article 5 (1) (a):

" (iii) a paper seal suitable for sealing an envelope,",

(iii) the addition of the following sub-paragraph to article 5 (1) (b):

"(iii) a paper seal suitable for sealing an envelope,",

(iv) the addition of " and on the paper seal therein " to article 5 (3) (a),

(v) the substitution for article 5 (4) of the following sub-article:

"(4) An identification mark printed or stamped on a label affixed to a specimen tube in an envelope, on copies of the form of certificate and on the paper seal in such envelope shall not be printed or stamped on any other label, form of certificate or paper seal supplied by the Bureau.",

(vi) the insertion of " on the paper seal " after " blood specimen tube " in article 8 (3) (a),

(vii) the deletion of " contained in the container " from article 8 (3) (d),

(viii) the substitution for article 8 (3) (g) of the following paragraph:—

"(g) close the envelope and seal it with the paper seal supplied by the Bureau in accordance with paragraph (a) of sub-article (1) of article 5.",

(ix) the insertion of " on the paper seal " after " urine specimen tube " in article 9 (4) (a),

(x) the substitution for article 9 (4) (e) of the following paragraph:—

"(e) close the envelope and seal it with the paper seal supplied by the Bureau in accordance with paragraph (b) of sub-article (1) of article 5.",

(xi) the insertion of " and sealed with a paper seal " after " closed " at reference 3 of the First Schedule,

(xii) the insertion of " and on paper seal " after " certificate "at reference 4 of the First Schedule,

(xiii) the insertion of " and on paper seal " after " certificate "at reference 5 of the First Schedule,

(xiv) the insertion of " by registered post " after " issue " at reference 12 of the First Schedule,

(xv) the insertion of "(a) by hand to applicant at his request, (b) by registered post (delete whichever is not applicable)" after " analysis " at reference 19 of the First Schedule,

(xvi) the insertion of " containing a paper seal bearing the same identification mark " after " envelope " in paragraph (a) (i) of Part I of the Third Schedule,

(xvii) the insertion of " or on any other paper seal supplied by the Bureau " after " Bureau " in paragraph (a) (ii) of Part I of the Third Schedule,

(xviii) the insertion of "and was sealed with a paper seal bearing the same identification mark as the copy of the certificate referred to in sub-paragraph (iv)" after "receipt" in paragraph (a) (v) of Part I of the Third Schedule,

(xix) the insertion of " containing a paper seal bearing the same identification mark " after " envelope " in paragraph (a) (i) of Part II of the Third Schedule,

(xx) the insertion of "or on any other paper seal supplied by the Bureau" after "Bureau" in paragraph (a) (ii) of Part II of the Third Schedule,

(xxi) the insertion of " and was sealed with a paper seal bearing the same identification mark as the copy of the certificate referred to in sub-paragraph (iv) " after " receipt " in paragraph (a) (v) of Part II of the Third Schedule.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic Act, 1968 (Part V) Regulations, 1969. Their principal effect is to vary the procedures to be followed in relation to the application of blood and urine tests so as to provide for a sealing procedure for sealing specimens of blood or urine which are being sent to the Medical Bureau of Road Safety for analysis.

Other minor amendments are made in relation to these procedures.
