RETAIL PRICE (BEVERAGES IN LICENSED PREMISES) DISPLAY ORDER, 1972.

I, PATRICK J. LALOR, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 19 of the Prices Act, 1958 (No. 4 of 1958), as amended by the Prices Act, 1972 (No. 20 of 1972), hereby order as follows :

1. This Order may be cited as the Retail Price (Beverages in Licensed Premises) Display Order, 1972.

2. This Order shall come into operation on the 20th day of November, 1972.

3. In this Order "premises" includes any place where intoxicating liquor is sold by retail.

4. Every person who carries on the business of selling intoxicating liquor by retail shall exhibit a notice at the premises where the business is carried on which shall—

(a) specify each kind of beverage (whether alcoholic or nonalcoholic) on sale at the premises, and the quantities, measures or units thereof by reference to which the price or prices charged therefor for consumption on the premises or for consumption off the premises or for consumption both on and off the premises, as the case may be, is or are calculated,

(b) specify, opposite the mention of each such kind of beverage, the price or prices charged for the quantities, measures or units specified of each such kind of beverage for consumption on the premises, or for consumption off the premises or for consumption both on and off the premises, as the case may be, and

(c) if different prices are charged in different parts of the premises for the same quantity, measure or unit of any beverage, specify the different parts of the premises in which the different prices are charged.

5. If a notice exhibited at a premises pursuant to Article 4 of this Order specifies different prices for specified different parts of the premises, the Article shall be deemed not to have been complied with unless the notice is also exhibited in each such part of the premises.

6. A notice exhibited pursuant to this Order shall be in such a position as to be clearly visible and easily accessible—

(a) in case it is exhibited pursuant to Article 4 of this Order, to all persons frequenting the premises where it is exhibited before or immediately after entering the premises, and

(b) in case it is exhibited pursuant to Article 5 of this Order, to all persons frequenting the part of the premises where it is exhibited.

7. A notice exhibited pursuant to this Order shall be in such form as to be capable of being easily read—

(a) in case it is exhibited pursuant to Article 4 of this Order, by all persons frequenting the premises where it is exhibited, and

(b) in case it is exhibited pursuant to Article 5 of this Order, by all persons frequenting the part of the premises where it is exhibited,

and the letters and figures on the notice shall be at least three millimetres in height and of proportionate width.

EXPLANATORY NOTE.

This Order provides for the display in all licensed premises, of the tax-inclusive prices at which all intoxicating liquor and nonalcoholic beverages are sold whether for consumption on the premises or elsewhere.

The Order also provides that where different prices operate for different sections of premises, the prices operative in all sections of the premises shall be displayed in each section thereof.
