HARBOURS AND PILOTAGE (RATES AND CHARGES) (DECIMAL CURRENCY) ORDER, 1971.

I, BRIAN LENIHAN, Minister for Transport and Power, in exercise of the powers conferred on me by section 10 of the Decimal Currency Act, 1970 (No. 21 of 1970), hereby, with the consent of the Minister for Finance, make the following order:

1. (1) This Order may be cited as the Harbours and Pilotage (Rates and Charges) (Decmal Currency) Order, 1971.

(2) This Order shall come into force on decimal day.

2. (1) This Order applies to a statute or statutory instrument passed or made before decimal day and which fixes or otherwise regulates rates or charges of any kind whatsoever which may be charged by any one or more of the following bodies, namely:

(a) a harbour authority within the meaning of the Harbours Act, 1946 (No. 9 of 1946),

(b) any other body which is a harbour authority within the meaning of the Harbours (Regulation of Rates) Act, 1934 (No. 2 of 1934), and

(c) a pilotage authority for the purposes of the Pilotage Act, 1913.

(2) This Order also applies to the Saleen Pier (Quayage and and Wharfage Rates) Order, 1944 (S.R. & O., No. 351 of 1944).

3. (1) Where a statute or statutory instrument to which this Order applies contains a reference to an amount of money in the old currency which is not a whole number of pounds, the following provisions shall have effect:

(a) if the reference is not a reference of a class described in subparagraph (b) of this paragraph, it shall, in so far as it refers to a sum in shillings or pence, be construed as referring to the corresponding sum in the new currency calculated in accordance with the Schedule to this Order,

or

(b) if the reference is part of a rate, percentage, proportion, formula or other basis of calculation, the statute or statutory instrument shall be construed and have effect as if it required any calculation on foot of the reference to be calculated in the new currency on the basis of five twelfths of a new penny being equal to one penny and to be calculated to two decimal places of a new penny and the statute or statutory instrument shall in addition be construed as enabling any amount chargeable thereunder to be rounded off to the nearest new penny.

(2) A provision in a statute or statutory instrument to which this Order applies which requires or enables an amount of money in the old currency not being a whole number of pounds to be rounded off shall be of no effect and shall be disregarded.

SCHEDULE

Method of Calculating in Certain Cases the Amount in New Pence corresponding to an Amount in Shillings and Pence.

The amount in the new currency corresponding to an amount in shillings, shillings and pence or pence shall be calculated as follows:

(a) for any whole two shillings or multiple thereof the corresponding amount in the new currency shall be taken to be ten new pence or that multiple thereof;

(b) for any amount or remaining amount of less than two shillings shown in column (1) of the following Table the corresponding amount in the new currency shall be taken to be the amount (if any) in new pence shown opposite that amount in column (2) of that Table (and accordingly an amount or remaining amount of one penny shall be disregarded).

EXPLANATORY NOTE.

This order specifies the basis of conversion to decimal currency of rates or charges which may be charged by harbour and pilotage authorities and for which there are no exact decimal currency equivalents.
