S.I. No. 54 of 1971.

DECIMAL CURRENCY (AMENDMENT OF REFERENCES) ORDER, 1971.

I, SEOIRSE Ó COLLA, Minister for Finance, in exercise of the powers conferred on me by section 10 of the Decimal Currency Act, 1970 (No. 21 of 1970), hereby order as follows:

1. This order may be cited as the Decimal Currency (Amendment of References) Order, 1971.

2. (1) Subject to the subsequent provisions of this Article, this Order shall come into operation on the 15th day of February, 1971.

(2) The amendments to sections 27 and 28 of the Charitable Loan Societies (Ireland) Act, 1843 specified at reference number I in Part I of the Schedule to this Order shall not apply in relation to loans to which the enactment mentioned at that reference number applies and which were made before the said 15th day of February, 1971.

(3) The amendments specified at reference number 6 in Part I of the Schedule to this Order shall not apply in relation to a loan to which the enactment mentioned at that reference number applies and which was made before the said 15th day of February, 1971,

3. (1) Each enactment mentioned in column (3) of Part I of the Schedule to this Order is hereby amended as specified in column (4) of that Part.

(2) Each instrument mentioned in column (3) of Part II of the Schedule to this Order is hereby amended as specified in column (4) of that Part.

(3) Where an allowance to which the enactment mentioned at reference number 5 in Part I of the Schedule to this Order applies is in course of payment on the 15th day of February, 1971, the amendment specified at that reference number shall apply to the amount of the allowance in course of payment on that date, or if the allowance stands suspended or abated on that date, to the amount thereof that would have been in course of payment on that date if it did not then stand suspended or abated.

In section 27 "1p in the pound for twelve weeks" shall be substituted for "Four-pence in the Pound for Twenty Weeks";

In section 31 "1p" shall be substituted for "Three-pence".

In section 9 (b) "0.25p" shall be substituted for "one halfpenny";

In section 9 (c) "0.5p" shall be substituted for "one penny".

In section 6 (2) "0.208p" shall be substituted for "one halfpenny";

In section 6 (3) "0.416p" shall be substituted for "one penny";

In section 6 (4) "0.416p" shall be substituted for "one penny".

Superannuation and Pensions Act, 1963 .

In section 25 "the sum of an amount which is an exact multiple of 12p plus an amount which is less than 12p, such annual amount shall be 12p plus the amount which is an exact multiple of 12p" shall be substituted for the words from "a whole number" to the end of the section.

Pawnbrokers Act, 1964 .

In the Second Schedule "twenty-five new pence" shall be substituted for "two shillings" in each place where it occurs in paragraph 1, "one new halfpenny" shall be substituted for "one halfpenny" in the said paragraph 1, "one new penny" shall be substituted for "two pence" in paragraph 2, "thirty new pence" shall be substituted for "five shillings" in both places where it occurs in paragraph 3 and "one new penny" shall be substituted for "two pence" in the said paragraph 3;

In the Fifth Schedule "one new halfpenny" shall be substituted for "one halfpenny" in Part 1 and "twenty-five new pence" shall be substituted for "two shillings" in each place where it occurs in the said Part I, "one new penny" shall be substituted for "two pence" in Part II, "thirty new pence" shall be substituted for "five shillings" in both places where it occurs in Part III and "one new penny" shall be substituted for "two pence" in the said Part III.

In Part I of the Second Schedule "13p" shall be substituted for "2/6d.";

In Part II of the Second Schedule "37p" shall be substituted for "7s. 6d" and "13p" shall be substituted for "2s. 6d";

In Part I of the Third Schedule "87p" shall be substituted for "17s. 6d.".

EXPLANATORY NOTE.

This Order amends certain statutes and statutory instruments containing references to amounts of money in £sd which are not a whole number of pounds and for which conversion on an exact equivalent basis under section 9 of the Decimal Currency Act 1970 would not be satisfactory.
