MILK (RETAIL PRICE) (DUBLIN SALE DISTRICT) (NO. 2) ORDER, 1970.

I, PATRICK J. LALOR, Minister for Industry and Commerce, in exercise of the powers conferred on me by the joint operation of section 52 of the Milk (Regulation of Supply and Price) Act, 1936 (No. 43 of 1936), and of the Minister for Supplies (Transfer of Functions under section 52 of the Milk (Regulation of Supply and Price) Act, 1936 ) Order, 1941 (S.R. & O., No. 29 of 1941), and of the Minister for Supplies (Transfer of Functions) Act, 1945 (No. 21 of 1945), hereby order as follows:

1. (1) This Order may be cited as the Milk (Retail Price) (Dublin Sale District) (No. 2) Order, 1970.

(2) This Order shall come into operation on the 1st day of December, 1970.

2. In this Order—

"the Dublin Sale District" means the area consisting of the county borough of Dublin, the county of Dublin and the urban district of Bray;

"fresh milk" has the meaning assigned to it by the Milk and Dairies Act, 1935 (No. 22 of 1935), and the regulations made thereunder;

"bottled milk" means fresh milk placed in any closed receptacle of a capacity exceeding a half-pint and not exceeding one quart at a wholesaler's or retailer's premises;

"highest grade milk" means milk which is Highest Grade Milk within the meaning of the Milk and Dairies (Special Designations) Regulations, 1938 to 1955;

references to selling shall be construed as including references to agreeing or offering to sell.

3. (1) The maximum prices at which bottled milk (other than highest grade milk) may be sold retail in any place in the Dublin Sale District during each of the months December, 1970, and January, 1971, and between the 1st day of February, 1971, and the 14th day of February, 1971, shall be prices calculated at the rate of 10d. per pint.

(2) The maximum prices at which bottled milk (other than highest grade milk) may be sold retail in any place in the Dublin Sale District between the 15th day of February, 1971, and the 28th day of February, 1971, and during each of the months March, 1971, and April, 1971, shall be prices calculated at the rate of 4 new pence per pint.

4. The Milk (Retail Price) (Dublin Sale District) Order, 1970 ( S.I. No. 59 of 1970 ), is hereby revoked.

EXPLANATORY NOTE.

This Order fixes the maximum retail price for the five months commencing on 1st December, 1970 for bottled milk (other than highest grade milk) in the Dublin Sale District as defined in the Order.
