S.I. No. 234/1970 - Garda Síochána (Retirement) Regulations, 1970.


I, DESMOND O'MALLEY, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Retirement) Regulations, 1970.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Garda Síochána (Retirement) Regulations, 1934 (S.R. & O., No. 146 of 1934), are hereby amended by the insertion after subparagraph (2) (inserted by the Garda Síochána (Retirement) Regulations, 1965 ( S.I. No. 34 of 1965 )), of paragraph 5 of the following subparagraph:

"(3) Notwithstanding the provisions of subparagraph (1) of this paragraph, the Commissioner may, with the consent of the Minister, direct that those members of the Garda Síochána who would be due to retire under the provisions of the said subparagraph (1) during the period from the 1st day of October, 1970, to the 31st day of December, 1970, may continue to serve in an established capacity in the Garda Síochána during, in the case of each such member, the period from the date on which he would have retired as aforesaid to the 1st day of January, 1971."

EXPLANATORY NOTE.

These Regulations provide for the extension of service of members of the Force due to retire on reaching the statutory age limits between 1st October, 1970 and 31st December, 1970, up to and including 1st January, 1971.
