HARBOUR RATES (YOUGHAL HARBOUR) ORDER, 1970.

I, BRIAN LENIHAN, Minister for Transport and Power, in exercise of the powers conferred on me by section 104 of the Harbors Act, 1946 (No. 9 of 1946) and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and after due compliance with section 106 of the said Act hereby order as follows:

1. This Order may be cited as the Harbour Rates (Youghal Harbour) Order, 1970.

2. This Order shall come into operation on the 25th day of August, 1970.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. The Harbour Rates (Youghal Harbour) Order, 1943 (S.R. & O., No. 346 of 1943), is hereby amended by—

( a ) the insertion at the end of Part I of the Schedule thereto of the following:

"On every yacht and other pleasure boat entering or using the harbour ... ... ... ... ... ...

On every yacht and other pleasure boat entering or using the harbour, payable in advance on the 1st day of June each year as a composition in full for one year of all tonnage rates mentioned in this Part if the gross weight of the yacht or boat—

(a)

is less than 1 ton ... ... ... ... ... ...

( b ) the insertion in the said Part I after "ship, vessel and steamer" in each place where it occurs of "(other than a yacht or other pleasure boat)".

EXPLANATORY NOTE.

This Order authorises the Youghal Harbour Commissioners to charge tonnage rates on pleasure vessels.
