HIRING ORDER, 1970.

I, CHARLES J. HAUGHEY, Minister for Finance, in exercise of the powers conferred on me by section 6 of the Hire-Purchase (Amendment) Act, 1960 (No. 15 of 1960), and the Hire-Purchase (Transfer of Departmental Administration and Ministerial Functions) Order, 1968 ( S.I. No. 158 of 1968 ), hereby order as follows:

1. This Order may be cited as the Hiring Order, 1970.

2. The Hiring Order, 1968 ( S.I. No. 224 of 1968 ), is hereby amended—

(a) by the substitution of "the 28th day of January, 1970" for "the 5th day of November, 1968" in Articles 3 (1) and 11,

(b) by the substitution in Articles 9 (3) (a) and 9 (3) (b) of "reference numbers 1 to 7 (other than reference number 4 or a caravan)" for "reference numbers 1-3",

(c) by the insertion in Articles 9 (3) (c) and 9 (3) (d) of "or a caravan" after "hereto",

(d) by the insertion after Article 9 (3) (e) of the following— "(f) apply to the disposal of a radio receiving set or a television receiving set in pursuance of an agreement to let the set on hire to a person who is a patient in a hospital or nursing home or who hires the set for use in an educational institution.",

(e) by the insertion of the following Article after Article 12:

"13. (1) A person shall not dispose of any television receiving set in pursuance of an agreement to let that set on hire if he knows either—

(a) that payment of the amount of which actual payment is required to be made in respect of that agreement by paragraph 3 of Part I of Schedule 2 hereto was facilitated by the insertion of coins in a slot meter or other device used for the purposes of operating, or otherwise in conjunction with, any other television receiving set which was disposed of at any time during the period of nine months immediately preceding the making of that agreement, by that or any other person to the person who is the hirer under that agreement or to any other person; or

(b) that such other television receiving set was so disposed of with the intention that such a payment in respect of that agreement would be so facilitated.

(2) Notwithstanding paragraph (1) of Article 9 hereof, this Article shall apply irrespective of when the other television receiving set was manufactured.",

(f) by the substitution for "twenty weeks" in each place where it occurs in paragraphs 1, 2 (d), 3 and 4 (d) of Part I of Schedule 2 of "thirty weeks in the case of goods of any of the descriptions specified at reference numbers 2 and 4 of Schedule I hereto or twenty-five weeks in the case of goods of any of the descriptions specified at reference numbers 1, 3, 5, 6 and 7 of Schedule 1 hereto",

(g) by the substitution in the proviso to paragraph 3 (2) of Part I of Schedule 2 of "a radio receiving set or a television receiving set, whether or not assembled and including a portable set, a set designed for use in a road vehicle, a cathode ray tube, a loudspeaker, a television conversion set" for "any of the goods described at reference number 1 in Schedule 1 hereto", and

(h) by the substitution for Schedule 1 of the following:

"SCHEDULE 1

Goods to which this Order applies

Description of Goods

1. Radio receiving sets and television receiving sets, whether or not assembled and including portable sets and sets designed for use in road vehicles; television aerials, cathode ray tubes, loudspeakers and television conversion sets; photographic equipment not designed specifically for industrial, scientific or commercial use; caravans

2. Gramophones, radio-gramophones, record players, juke boxes and tape recorders

3. Appliances and apparatus (whether mechanically operated or not) of the following kinds designed exclusively or mainly for domestic use:

Dish washers

Drying cabinets and drying machines

Washing machines and washers

Water heating appliances

Electric kettles

Ironing machines and irons

Wringers and mangles

Pressure cookers

Floor polishers

Vacuum cleaners

Sewing machines

Knitting machines

Hair-drying machines

Food-mixing machines

Refrigerators having a storage capacity not exceeding 12 cubic feet

Electric blankets

4. (a) Mechanically propelled vehicles constructed primarily for the carriage of persons and having seating accommodation for not less than one or more than eight persons (excluding the driver), excluding small public service vehicles within the meaning of the Road Traffic Act, 1961

(b) Station wagons, estate cars and other similar vehicles which are constructed or adapted for alternative purposes.

6. Cookers designed exclusively or mainly for domestic purposes (including solid fuel cookers but excluding pressure cookers); carpets; furniture

7. All goods not already specified in this Schedule except the following:

Medical, surgical, dental and veterinary appliances, equipment and apparatus

Ambulances, invalid carriages, vehicles specially constructed or adapted for disabled people

Hearses, vehicles (other than those specified at reference 4 of this Schedule) constructed or adapted for the commercial carriage of goods or not less than eight persons (excluding the driver), small public service vehicles

Tractors

Trailers (other than caravans) having a maximum unladen weight of not less than 10 cwt

Caravans having an overall length (excluding any drawbar) exceeding 22 feet or an overall width exceeding 7 feet 6 inches

Motorcycles, autocycles, cycles fitted with an auxiliary motor (whether with or without sidecars), bicycles

Ships and boats constructed or adapted for commercial transportation of goods or passengers; tugs and commercial fishing vessels; equipment for such a ship, tug or vessel

Aircraft and aircraft engines

Agricultural, industrial and office machinery and accessories therefor; hand tools

Photographic equipment designed specifically for industrial, scientific or commercial use

Refrigerators having a storage capacity exceeding 12 cubic feet

Appliances and apparatus designed exclusively or mainly for non-domestic use.".

EXPLANATORY NOTE.

This Order amends the Hiring Order, 1968, by increasing the number of weeks' rental payable in advance on goods already subject to the Order and extends the range of goods to which the Order applies.
