CONDITIONS OF EMPLOYMENT (POLYPROPYLENE INDUSTRY) (EXCLUSION) REGULATIONS (No. 2) 1968.

I, P. S. Ó h-IRIGHILE, Minister for Labour, in exercise of the powers conferred on me by sections 29 and 52 of the Conditions of Employment Act, 1936 (No. 2 of 1936), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), and after consultation with representatives of employers and with representatives of workers so interested, hereby make the following regulations:—

1. These Regulations may be cited as the Conditions of Employment (Polypropylene Industry) (Exclusion) (No. 2) Regulations, 1968.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The following form of industrial work, namely, the processing of polypropylene, is hereby declared to be excluded industrial work for the purpose of section 46 of the Conditions of Employment Act, 1936 (No. 2 of 1936), and the following provisions shall have effect in respect of the work to which these Regulations relate:

(a) no woman shall be employed to do any such work at any time between the hour of 11 p.m. on any day and the hour of 7 a.m. on the following day.

(b) no woman shall be so employed on any day until after the expiration of eleven hours from the time at which such woman ceases to do industrial work on the previous day.

4. The following form of industrial work, namely, the processing of polypropylene, is hereby declared to be excluded industrial work for the purpose of section 47 of the Conditions of Employment Act, 1936 (No. 2 of 1936), and the following provisions shall have effect in respect of the work to which these Regulations relate:

(a) no young person shall be employed to do any such work at any time between the hour of 10 p.m. on any day and the hour of 7 a.m. on the following day;

(b) no young person shall be so employed on any day until after the expiration of eleven hours from the time at which such young person ceased to do industrial work on the previous day.

5. The Conditions of Employment (Polypropylene Industry) (Exclusion) Regulations, 1968 ( S.I. No. 41 of 1968 ), are hereby revoked.

EXPLANATORY NOTE.

The Conditions of Employment Act, 1936 provides that female adult workers may not be employed on shift work between the hours of 10 p.m. and 8 a.m. and young persons may not be employed on shift work between 8 p.m. and 8 a.m.

The purpose of these Regulations is to permit female adult workers to be employed between the hours of 7 a.m. and 11 p.m. and young person between 7 a.m. and 10 p.m. on shift work in the processing of polypropylene.

The Conditions of Employment (Polypropylene Industry) (Exclusion) Regulations, 1968 (S.I. 41 of 1968) have been revoked).
