BRUCELLOSIS IN CATTLE (MOVEMENT CONTROL) (AMENDMENT) ORDER, 1968.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, it appearing to me to be necessary for the purpose of the progressive eradication of brucellosis in cattle, do hereby, in exercise of the powers conferred on me by sections 3 and 20 of the Diseases of Animals Act, 1966 (No. 6 of 1966), order as follows:

1. (1) This Order may be cited as the Brucellosis in Cattle (Movement Control) (Amendment) Order, 1968.

(2) The Order of 1967 and this Order may be cited together as the Brucellosis in Cattle (Movement Control) Orders, 1967 and 1968.

(3) This Order shall come into operation on the 1st day of March, 1968

2. In this Order—

"the area" has the meaning specified in Article 3 of the Order of 1967, as amended by this Order;

"herd" includes a herd consisting of one animal only;

"the Order of 1966" means the Brucellosis in Cattle (Declaration of Clearance Area and Movement Control) Order, 1966 ( S.I. No. 121 of 1966 );

"the Order of 1967" means the Brucellosis in Cattle (Movement Control) Order, 1967 ( S.I. No. 62 of 1967 ).

3. The Order of 1967 shall be amended as follows:

(a) the definition of "eligible animal" in Article 2 is hereby amended by the insertion of", as amended by the Brucellosis in Cattle (Clearance Area) (General Provisions) (Amendment) Order, 1960 ( S.I. No. 44 of 1968 )," after "( S.I. No. 120 of 1966 )"; and

(b) Article 3 is hereby amended by the substitution of "counties of Cavan, Donegal, Leitrim, Monaghan and Sligo)" for "county of Donegal".

4. (1) Where, immediately before the commencement of this Order, a restriction on movement under Article 8 (1) of the Order of 1966 was in force in relation to a herd in the area and the requirement of subparagraph (b) of the said Article 8 (1) was not then complied with by the person to whom it related, notwithstanding Article 16 (1) of the Order of 1967, the said requirement shall in relation to the person continue in force in the same manner as if this Order had not come into operation.

(2) Where, immediately before the commencement of this Order, Order, a restriction on movement under Article 8 (3) of the Order of 1966 was in force in relation to an animal in a herd in the area, notwithstanding Article 16 (1) of the Order of 1967, the following provisions shall apply:

(a) subparagraphs (a) and (c) of the said Article 8 (3) and Article 8 (4) of the Order of 1966 shall in relation to the animal continue in force in the same manner as if this Order had not come into operation; and

(b) in case the requirement of subparagraph (b) of the said Article 8 (3) was not then complied with the said requirement shall in relation to the owner or person in charge of the animal continue in force in the same manner as if this Order had not come into operation.

EXPLANATORY NOTE.

This Order by amending the Brucellosis in Cattle (Movement Control) Order, 1967, (1) controls the movement of certain classes of animals into counties Cavan, Leitrim, Monaghan and Sligo and into and out of certain herds in these counties (2) requires the surrender and transfer of brucellosis certified cards in certain circumstances and (3) these four counties from the provisions of the Brucellosis in Cattle (Declaration of Clearance Area and Movement Control) (Amendment) Order, 1966 except those which declare the counties to be in the Clearance Area in which brucellosis is to be eradicated.
