LIMERICK TRAFFIC AND PARKING TEMPORARY RULES, 1968.

I, PATRICK CARROLL, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 (3) and 90 (7) of the Road Traffic Act, 1961 (No. 24 of 1961), and with the consent of the Minister for Local Government, hereby make the following temporary rules in respect of the area comprising the streets, portions of streets and bridges specified in column (2) of the Schedule to these rules:—

1 Short title.

1. These rules may be cited as the Limerick Traffic and Parking Temporary Rules, 1968.

2 Commencement.

2. These rules shall come into operation on the 1st day of March, 1968.

3 Definitions.

3. In these rules—

"Act" means the Road Traffic Act, 1961 (No. 24 of 1961);

"holiday" means any of the following days—

St. Patrick's Day or, if it falls on a Sunday, the following day,

Easter Monday.

the first Monday in June,

the first Monday in August,

Christmas Day or, if it falls on a Sunday, the following Tuesday,

St. Stephen's Day or, if it falls on a Sunday, the following day,

or, whenever a day is appointed under the Public Holidays Act, 1924 (No. 56 of 1924), to be a bank holiday instead of any of those days, the day so appointed;

"the Schedule" means the Schedule to these rules;

"scheduled place" means a street, part of a street or bridge specified in column (2) of the Schedule;

"vehicle" does not include a pedal cycle.

4 Prohibition on stopping or parking of vehicles.

4. Subject to rule 5 in a scheduled place the stopping or the parking for any purpose of a vehicle on a day which is not a Sunday or holiday is hereby prohibited during the period specified in column (3) of the Schedule opposite the mention in column (2) thereof of that scheduled place.

5 Non-application of rule 4.

5. Rule 4 shall not apply to—

( a ) an omnibus stopped at a stopping place or stand directed by notice under section 85 of the Act,

( b ) a small public service vehicle while merely picking up or setting down passengers,

( c ) a vehicle stopped when either the stopping is required under the Act or the Road Traffic General Bye-Laws, 1964 ( S.I. No. 294 of 1964 ), or is caused by the exigencies of traffic,

( d ) a vehicle being used in connection with—

(i) the removal of obstruction to traffic,

(ii) the maintenance, improvement or reconstruction of a street or part thereof, or

(iii) the provision, alteration or repair of a sewer, or of any main, pipe or apparatus for the supply of gas, water or electricity, or of a telegraphic or telephonic line,

( e ) a fire engine or ambulance, or a vehicle being used in pursuance of the powers and duties of the Garda Síochána by a member thereof,

( f ) a vehicle stopped or parked because the stopping or parking is necessary in order to avoid an accident.

6 Amendment of Limerick Parking Temporary Rules, 1967.

6. The Limerick Parking Temporary Rules, 1967 ( S.I. No. 185 of 1967 ), are hereby amended by the insertion after rule 5 (2) of the following:

"(3) Paragraph (2) shall not apply, during the period beginning at 5.30 p.m. on a weekday and ending at 6.30 p.m. on that weekday, to the portion of the street mentioned at reference number 2 in Part 1 of the said Second Schedule."

EXPLANATORY NOTE.

Rule 4 prohibits the stopping or parking of a vehicle for any purpost from Mondays to Saturdays inclusive (other than holidays) during the hours specified in column (3) of the Schedule, except in the case of an omnibus or a small public service vehicle which is actually engaged in picking up or setting down passengers.

These rules operate in lieu of Limerick Parking Bye-Laws, 1963 ( S.I. No. 62 of 1963 ) during the period of operation of these rules in the street or portions of streets specified in column (2) of the Schedule and amend the Limerick Parking Temporary Rules, 1967( S.I. No. 185 of 1967 ) to the extent shown at rule 6.
