DISEASES OF ANIMALS (RESTRICTION OF MOVEMENT OF CATTLE, SHEEP AND SWINE) ORDER, 1967.

I, NEIL T. BLANEY, Minister for Agriculture and Fisheries in exercise of the powers conferred on me by sections 3 , 30 and 48 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. (1) This Order may be cited as the Diseases of Animals (Restriction of Movement of Cattle, Sheep and Swine) Order, 1967.

(2) This Order shall come into operation on the 13th day of December, 1967.

2. (1) In this Order—

"authorised officer" means a person appointed by the Minister in writing to be an authorised officer for the purposes of this Order;

"the Minister" means the Minister for Agriculture and Fisheries;

"port" includes place.

(2) This Order applies to the following animals, namely, any cattle, sheep or swine.

3. The movement of any animal to which this Order applies from—

(a) a livestock mart licensed under section 3 of the Livestock Marts Act, 1967 (No. 20 of 1967);

(b) a market held under the Dublin Corporation (Markets) Act, 1899;

(c) any fair exempted from the provisions of the Foot and Mouth Disease (Restriction of Exhibition and Sale of Bovine Animals) Order, 1967 ( S.I. No. 263 of 1967 );

is hereby prohibited unless the animal is moved under and in accordance with a licence granted in that behalf by the Minister.

4. (1) The movement of any animal to which this Order applies to a port for export is hereby prohibited unless the animal is moved either:

(a) in accordance with a condition attached to a licence granted by the Minister for the purposes of the Foot and Mouth Disease (Importation of Animals) Order, 1967 ( S.I. No. 235 of 1967 ), as amended by the Foot and Mouth Disease (Importation of Animals) (Amendment) Order, 1967 ( S.I. No. 282 of 1967 ), and is accompanied by the licence, or

(b) under and in accordance with and is accompanied by, a licence granted by the Minister in that behalf for the purposes of this Order.

(2) A licence mentioned in paragraph (1) shall be delivered to the proper officer of Customs and Excise at the time of exportation of an animal to which it relates.

5. Subject to Article 4 (2), in case a licence has been granted for the purposes of this Order by the Minister, the person who is in charge of an animal to which the licence relates shall have the licence in his possession.

6. Subject to Article 9, in case a condition attached to a licence granted for the purposes of this Order specifies a place to which animals are to be moved, the animals to which the licence relates shall, save as may be otherwise provided by the condition, forthwith be moved directly to that place and shall, while in transit thereto, neither be detained nor be allowed to mix with other animals to which this Order applies.

7. A person having in his possession pursuant to this Order a licence shall, on demand made by a member of the Garda Síochána or an inspector of the Minister or an authorised officer, produce it for inspection by such member, inspector or officer.

8. In case the Minister attaches a condition to a licence granted for the purposes of this Order, the person who is in charge of an animal to which the licence relates shall comply with the condition and any failure by such person, whether by act or omission, to comply with any such condition is hereby declared to be an offence.

9. Nothing in this Order shall be construed as affecting the operation of, (i) any Order made under section 28 (b) or section 29 (b) of the Diseases of Animals Act, 1966 (No. 6 of 1966), or (ii) any instrument being an instrument mentioned in section 9 (3) of the said Act and made under the provisions of the Diseases of Animals Acts, 1894 to 1960, and corresponding to the said sections 28 (b) or 29 (b).

EXPLANATORY NOTE.

This Order prohibits, except in accordance with the terms of a licence, the movement on and after 13th December, 1967, of any cattle, sheep or swine

(i) from Dublin Cattle Market, or from any licensed livestock mart, or

(ii) for export.

When a licence specifies a destination to which animals to which the Order applies are to be consigned, the animals in question must be conveyed immediately and directly to the destination specified and they may not (except as may be provided for in the licence) be detained or be allowed to mix with other animals while in transit.

Animals while in transit must be accompanied by the necessary movement licence.
