MAXIMUM PRICES (INTOXICATING LIQUOR AND NON-ALCOHOLIC BEVERAGES) ORDER, 1965.

I, PÁDRAIG Ó hIRIGHILE, Minister for Industry and Commerce, having considered a report of the Fair Trade Commission under section 7 of the Restrictive Trade Practices Act, 1953 (No. 14 of 1953), as amended by the Restrictive Trade Practices (Amendment) Act, 1959 (No. 37 of 1959), into the conditions obtaining in regard to the supply and distribution of intoxicating liquor and non-alcoholic beverages and being of opinion that—

(a) restrictive practices, in connection with the supply and distribution of such liquor and beverages, exist, and

(b) by reason of the existence of such restrictive practices, excessive prices are being charged for such liquor and beverages,

hereby, in exercise of the powers conferred on me by section 13 of the Prices Act, 1958 (No. 4 of 1958), order as follows :

1. This Order may be cited as the Maximum Prices (Intoxicating Liquor and Non-alcoholic Beverages) Order, 1965.

2. This Order shall come into operation on the 24th day of November, 1965.

3.—(1) The maximum price at which—

(a) intoxicating liquor of any kind, or

(b) a non-alcoholic beverage of any kind sold in or from bottles or cans—

may be sold by retail in any circumstances shall be the price at which intoxicating liquor or a beverage of that kind was sold by retail in the same or similar circumstances immediately before the 1st day of May, 1965, increased, in case—

(i) a duty of customs (including Special Import Levy) or a duty of excise was or is imposed on or after the 1st day of May, 1965 and is chargeable thereon, or

(ii) a duty of customs or a duty of excise thereon was or is increased on or after the 1st day of May, 1965 and is chargeable as so increased,

by the amount of the duty or the increase, as the case may be.

(2) In this paragraph " beverage " does not include milk, a medicinal or pharmaceutical preparation, or a beverage which normally is heated before being consumed.

EXPLANATORY NOTE.

This Order fixes the retail prices of intoxicating liquor and soft drinks at the levels which obtained prior to the Budget in May, 1965, and provides for the addition to those prices of any amounts of Customs or Excise duties imposed by the Budget and, in the case of imported drinks, the amount of Special Import Levy payable.
