S.I. No. 42/1965 - Garda Síochána (Representative Bodies) Regulations, 1962, (Amendment) Regulations, 1965.

I, BRIAN LENIHAN, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations:

1. These regulations may be cited as the Garda Síochána (Representative Bodies) Regulations, 1962 (Amendment) Regulations, 1965.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these regulations.

3. The Garda Síochána (Representative Bodies) Regulations, 1962 ( S.I. No. 64 of 1962 ), are hereby amended by—

(a) the insertion after "Garda Síochána" in the definition of District Officer in paragraph (1) of Regulation 2 of "or an Inspector acting for him",

(b) the insertion after "Garda Síochána" in the definition of Divisional Officer in paragraph (1) of Regulation 2 of "or a Superintendent acting for him",

(c) the substitution of the following paragraph for paragraph (2) of Regulation 2:

"(2) For the purposes of these Regulations the members of the Garda Síochána permanently assigned to Garda Headquarters shall be deemed to form a Division which in these Regulations is referred to as the Headquarters Division.",

(d) the insertion after paragraph (2) (inserted by these Regulations) of Regulation 2 of the following paragraph:

"(3) For the purposes of these Regulations the members of the Garda Síochána permanently assigned to the Garda Training Centre at Templemore in the county of Tipperary shall be deemed to form a Division which in these Regulations is referred to as the Training Centre Division.",

(e) the deletion from subparagraph (a) of paragraph (2) of Regulation 4 of "Dublin/Wicklow,",

(f) the substitution for "Headquarters/Depot Division" in subparagraph (a) of paragraph (2) of Regulation 4 of "Headquarters Division",

(g) the insertion after "Clare" in subparagraph (c) of paragraph (2) of Regulation 4 of, "the Training Centre",

(h) the substitution of the following subparagraph for subparagraph (d) of paragraph (2) of Regulation 4:

"(d) The Dublin Metropolitan Area shall be conterminous with the Dublin Metropolitan Garda Area and shall consist of the two Garda Divisions known as the Northern and Southern Divisions.",

(i) the substitution of the following paragraph for paragraph (3) of Regulations 5:

"(3) In each Division there shall be a Divisional Committee for Sergeants and a Divisional Committee for Guards.",

(j) the substitution of the following paragraph for paragraph (4) of Regulation 5:

"(4) (a) In each Area there shall be an Area Committee for Sergeants and an Area Committee for Guards.

(b) In the Dublin Metropolitan Area Station for Sergeants shall elect from their number an Area Committee for that rank.

(c) In each Area Inspectors shall elect from their number an Area Committee for that rank.",

(k) the deletion of paragraph (5) of Regulation 5,

(l) the substitution for "Headquarters/Depot Division" in paragraph (c) of Regulation 7 of "Headquarters Division",

(m) the insertion after "shall" in paragraph (2) of Regulation 10 of, "subject to paragraph (1) of Regulation 14",

(n) the deletion of subparagraph (b) of paragraph (3) of Regulation 10,

(o) the substitution for "Headquarters/Depot Division" in paragraph (3) of Regulation 20 of "Headquarters Division",

(p) the substitution of the following subparagraph for subparagraph (a) of paragraph (2) of Regulation 31:

"(a) The Sergeants and Guards (excluding recruits in training) serving in the Headquarters and the Training Centre Divisions shall respectively elect from their numbers the members to act as Divisional Committees for their respective ranks and Divisions.",

(q) the substitution of the following subparagraph for subparagraph (a) of paragraph (3) of Regulation 31:

"(a) The District Committees in the Dublin Metropolitan Area shall meet to elect the members of the Divisional Committees for their respective ranks and Divisions.",

(r) the deletion of subparagraph (c) of paragraph (3) of Regulation 31,

(s) the substitution of the following paragraph for paragraph (1) of Regulation 32:

"(1) (a) The Divisional Committees in each area shall meet to elect Area Committees for their respective ranks.

(b) Each Divisional Committee outside the Dublin Metropolitan Area shall elect, in the case of Sergeants, one member and, in the case of Guards, three members.

(c) Each Divisional Committee in the Dublin Metropolitan Area shall elect, in the case of Sergeants, four members and, in the case of guards, twelve members.",

(t) the deletion of "and the Area Committees in the Dublin Metropolitan Area" from paragraph (2) of Regulation 32,

and

(u) the substitution of the following paragraph for paragraph (1) of Regulation 33:

"(1) Station Sergeants and Inspectors shall elect from their numbers the members to act as the Area Committees for their respective ranks and areas.".

EXPLANATORY NOTE.

These Regulations bring the arrangements for the election of Garda representative committees into line with the changes made in the organisation of the Garda Síochána following the transfer of the Training Centre from Dublin to Templemore, the enlargement of the Dublin Metropolitan Area and the abolition of Dublin/Wicklow Division as a separate Division.
