SOCIAL WELFARE (CLAIMS AND PAYMENTS) (AMENDMENT) REGULATIONS, 1964.

I, CAOIMHGHÍN Ó BEOLÁIN, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 and 29 of the Social Welfare Act, 1952 (No. 11 of 1952) and section 47 of that Act as amended by section 12 of the Social Welfare (Amendment) Act, 1960 (No. 25 of 1960) and by section 13 of the Social Welfare (Miscellaneous Provisions) Act, 1963 (No. 26 of 1963), hereby make the following Regulations :—

1.—(1) These Regulations may be cited as the Social Welfare (Claims and Payments) (Amendment) Regulations, 1964.

(2) The Social Welfare (Claims and Payments) Regulations, 1952 to 1960 and these Regulations may be cited together as the Social Welfare (Claims and Payments) Regulations, 1952 to 1964.

2. The Social Welfare (Claims and Payments) Regulations, 1952 ( S.I. No. 374 of 1952 ) are hereby amended by the insertion after article 16 of the following article :—

" 16A.—(1) In the case of old age (contributory) pension, the Minister may, where it appears to him that the circumstances so warrant, appoint a person to receive and deal with, on behalf of a claimant or beneficiary, so much of the pension as is payable by virtue of section 26 of the Act.

(2) The following provisions shall apply to every appointment made by the Minister under this article :—

(a) the Minister may at any time revoke the appointment,

(b) the person appointed may resign on giving to the Minister one month's notice of his intention to do so.

(3) A person appointed under this article may receive and deal with, on behalf of the claimant or beneficiary, so much of the old age (contributory) pension as is payable by virtue of section 26 of the Act and the receipt of such person shall be a good discharge to the Minister and the Social Insurance Fund for any sums paid to such person on behalf of the claimant or beneficiary."

EXPLANATORY NOTE.

The adult dependant's allowance being paid to an old age (contributory) pensioner in respect of a wife or dependent husband is an integral part of the pension which is payable to the pensioner and not to the adult dependant. These Regulations empower the Minister to pay this allowance to or on behalf of the adult dependant where he considers that the circumstances so warrant.
