S.I. No. 193 of 1963.

MECHANICALLY PROPELLED VEHICLES (INTERNATIONAL CIRCULATION) (AMENDMENT) ORDER, 1963.

The Minister for Local Government in exercise of the powers conferred on him by section 38 of the Local Government Act, 1955 (No. 9 of 1955) hereby makes the following Regulations and Order:—

l.—(1) This Order may be cited as the Mechanically Propelled Vehicles (International Circulation) (Amendment) Order, 1963.

(2) This Order shall come into operation on the twenty-seventh day of October, 1963.

(3) The Mechanically Propelled Vehicles (International Circulation) Orders, 1961 and 1962 and this Order shall be construed as one and may be cited together as the Mechanically Propelled Vehicles (International Circulation) Orders, 1961 to 1963.

2. In this Order"the Principal Order" means the Mechanically Propelled Vehicles (International Circulation) Order, 1961 ( S.I. No. 269 of 1961 ).

3. Article 11 of the Principal Order shall be amended by the substitution therefor of the following article:—

"11. (1) Article 5 of the Road Traffic (Public Service Vehicles) Regulations, 1963 ( S.I. No. 191 of 1963 ) shall not apply to a vehicle brought into the State temporarily by a visitor if the vehicle is licensed in the state in which it is registered under the licensing requirements (if any) of that state corresponding to those of Part III of the Road Traffic (Public Service Vehicles) Regulations, 1963.

(2) Sub-article (5) of article 62 of the Road Traffic (Public Service Vehicles) Regulations, 1963 shall not apply to a visitor in respect of his employment as driver of a vehicle to which sub-article (1) of this article applies if such person is licensed as such in the state in which he is ordinarily resident under the special licensing requirements (if any) of that state governing the driving of vehicles used for the carriage of passengers for reward".

4. Article 12 of the Principal Order shall be amended by the deletion from sub-articles (1) and (2) of the words "Act of 1933 and the Orders and ".

5. The First Schedule to the Principal Order shall be amended by the substitution therefor of the Schedule to this Order.

SCHEDULE.

PART I

Provisions which are not to apply to a vehicle registered in a state which is a party to the Convention of 1926:

1. The Road Traffic (Lighting of Vehicles) Regulations, 1963 ( S.I. No. 189 of 1963 ).

2. The provisions of Parts I to VI of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 ( S.I. No. 190 of 1963 ), other than those provisions relating to—

(a) the weight, width, length and height of vehicles,

(b) the weight, width and length of trailers attached to vehicles,

(c) the weight, width and length of combinations of vehicles and trailers,

(d) the number of trailers attached to vehicles.

PART II

Requirements to be complied with by a vehicle registered in a state which is a party to the Convention on 1926:

1. The lights referred to in the Convention of 1926 shall be carried duly lit and in an efficient condition in the same circumstances as the corresponding obligatory lighting under the Road Traffic (Lighting of Vehicles) Regulations, 1963 would be required to be carried duly lit.

2. A vehicle (and any trailer attached thereto) shall not show a red light or a red reflector to the front or a white reflector or (save where the showing of such a light would be lawful under the Road Traffic (Lighting of Vehicles) Regulations, 1963) a white light to the rear.

PART III

Provisions which are not to apply to a vehicle registered in a state which is a party to the Convention of 1949:

1. The Road Traffic (Lighting of Vehicles) Regulations, 1963.

2. The provisions of Parts I to VI of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963, other than those provisions relating to—

(a) the weight, width, length and height of vehicles,

(b) the weight, width and length of trailers attached to vehicles,

(c) the weight, width and length of combinations of vehicles,

(d) the number of trailers attached to vehicles.

PART IV

Requirements to be complied with by a vehicle registered in a state which is a party to the Convention of 1949:

1. The lights referred to in the Convention of 1949 shall be carried duly lit and in an efficient condition in the same circumstances as the corresponding obligatory lighting under the Road Traffic (Lighting of Vehicles) Regulations, 1963 would be required to be carried duly lit.

2. A vehicle (and any trailer attached thereto) shall not show a red light or a red reflector to the front or a white reflector or (save where the showing of such a light would be lawful under the Road Traffic (Lighting of Vehicles) Regulations, 1963) a white light to the rear.

EXPLANATORY NOTE.

This Order provides for certain amendments to the Mechanically Propelled Vehicles (International Circulation) Order, 1961 ( S.I. No. 269 of 1961 ) consequential on the coming into operation of sections 11 , 12 and 82 of the Road Traffic Act, 1961 and the regulations thereunder, and the repeal of corresponding provisions of and under the Road Traffic Act, 1933 . It substitutes references to the new regulations for references to the provisions which they replace.
