BOVINE TUBERCULOSIS (ATTESTED AREA) (AMENDMENT) (No. 10) ORDER, 1963.

I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis and being satisfied that bovine tuberculosis is virtually non-existent in such area as consists of the administrative counties of Dublin, Laoighis and Wexford and the county borough of Dublin do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), as amended by section 5 of the. Diseases of Animals Act, 1960 (No. 26 of 1960), order as follows :

1. (1) This Order may be cited as the Bovine Tuberculosis (Attested Area) (Amendment) (No. 10) Order, 1963.

(2) This Order shall come into operation on the 15th day of April, 1963.

2. (1) Article 3 of the Bovine Tuberculosis (Attested Area) Order, 1960 ( S.I. No. 236 of 1960 ), as amended by the Orders specified in the next paragraph, is hereby further amended by the insertion after " the remaining part of the administrative county of Wicklow " of " and the administrative counties of Dublin, Laoighis and Wexford and the county borough of Dublin ".

(2) The Orders referred to in the foregoing paragraph are the Bovine Tuberculosis (Attested Area) (Amendment) Order, 1961 ( S.I. No. 9 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 2) Order, 1961 ( S.I. No. 17 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 3) Order, 1961 ( S.I. No. 29 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 4) Order, 1961 ( S.I. No. 156 of 1961 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 6) Order, 1962 ( S.I. No. 169 of 1962 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 7) Order, 1962 ( S.I. No. 192 of 1962 ), the Bovine Tuberculosis (Attested Area) (Amendment) (No. 8) Order, 1962 ( S.I. No. 201 of 1962 ) and the Bovine Tuberculosis (Attested Area) (Amendment) (No. 9) Order, 1963 ( S.I. No. 23 of 1963 ).

3. Article 13 of the Bovine Tuberculosis (Attested Area) Order, 1960, is hereby amended by the insertion after paragraph (1) of the following paragraph :—

" (1a) (a) It shall not be lawful for any person to move into the area under permit under this Article any animal unless there has been inserted in the left car of the animal before it is so moved an approved ear-tag.

(b) In this paragraph " approved ear-tag " means an ear-tag which—

(i) is such that when inserted in the ear of the animal it becomes effectively closed and, if subsequently removed, cannot be used again;

(ii) is such that, if identification letters or numbers borne by the ear-tag are altered (whether by addition, deletion or variation) the alteration is evident as such, and

(iii) is made of rigid, durable material and is clearly legible ".

4. Paragraph (4) of Article 14 of the Bovine Tuberculosis (Attested Area) Order, 1960, is hereby amended by the addition at the end of that paragraph of " or are moved direct to a public sale of cattle being held in the administrative county of Dublin or the county borough of Dublin ".

5. Article 8 of the Bovine Tuberculosis (Attested Area) (Amendment) (No. 6) Order, 1962, is hereby deleted.

6. The Bovine Tuberculosis (Clearance Area) (No. 2) Order, 1961 ( S.I. No. 137 of 1961 ), the Bovine Tuberculosis (Clearance Area) Order, 1962 ( S.I. No. 51 of 1962 ), the Bovine Tuberculosis (Clearance Area) (Special Controls) Order, 1962 ( S.I. No. 87 of 1962 ) (as amended by the Bovine Tuberculosis (Clearance Area) (Special Controls) (Amendment) Order, 1962 ( S.I. No. 152 of 1962 ) and the Bovine Tuberculosis (Clearance Area) (Special Controls) (Amendment) (No. 2) Order, 1962 ( S.I. No. 191 of 1962 ) ), and the Bovine Tuberculosis (Special Controls) (Dublin) Order, 1962 ( S.I. No. 193 of 1962 ), are hereby revoked.

EXPLANATORY NOTE.

This Order, by extending the provisions of the Bovine Tuberculosis (Attested Area) Order, 1960, as amended, declares the administrative counties of Dublin, Laoighis and Wexford and the county borough of Dublin to be an Attested Area, i.e., an area in which the Minister is satisfied that bovine tuberculosis is virtually non-existent, with effect from 15th April, 1963. It also (1) prohibits the tuberculin testing of cattle in the area except with the permission of the Minister, (2) prohibits the movement of cattle into the area, except under permit, and specifies the classes of cattle for which such permits shall be granted, (3) regulates the movement of cattle into and out of herds in the area, (4) controls public sales of cattle in the area, (5) requires, in certain circumstances, the surrender to the Department of Agriculture of identity cards and ear-tags relating to cattle, and (6) provides for the disposal of reactors.
