STREET SERVICE VEHICLES (DUBLIN) (LOST PROPERTY) BYE-LAWS, 1963.

I, DANIEL COSTIGAN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by section 87 of the Road Traffic Act, 1961 (No. 24 of 1961), hereby make the following bye-laws in respect of such area as consists of the county borough of Dublin and such portion of the county of Dublin (including the borough of Dún Laoghaire) as lies within a circle with a radius of ten miles and having its centre at the General Post Office situate in O'Connell Street in the City of Dublin :

1. These Bye-laws may be cited as the Street Service Vehicles (Dublin) (Lost Property) Bye-laws, 1963.

2. In these bye-laws—

" the Carriage Office " means the Garda Síochána Carriage Office situate at Number 1, Palace Street in the city of Dublin;

" the Dublin Metropolitan Garda Divisional Stores " means the premises known by that title and situate in Kevin Street Garda Síochána Station in the city of Dublin;

" officer " means an officer of the Garda Síochána;

" street service vehicle " has the meaning assigned to it by section 3 of the Road Traffic Act, 1961 (No. 24 of 1961).

3. (1) Whenever a passenger leaves property in a street service vehicle the driver of that street service vehicle shall within twenty-four hours of his finding the property either return it to the passenger or deposit it in the Carriage Office with the officer in charge of the Carriage Office.

(2) When calculating the period of twenty-four hours referred to in paragraph (1) of this bye-law the period beginning on any Saturday at 5.30 p.m. and ending on the following Monday at 9.30 a.m. shall be disregarded.

4. The officer in charge of the Carriage Office shall—

(a) make arrangements for the safe custody of property deposited in the Carriage Office under bye-law 3 of these bye-laws, including such arrangements as appear to him to be necessary or reasonable in respect of either live animals or goods of a perishable or offensive character;

(b) retain in the custody of the Carriage Office property deposited therein under bye-law 3 of these bye-laws for such period as appears to him to be necessary in order to dispose of the property under bye-laws 5 and 6 of these bye-laws.

5. Where the officer in charge of the Carriage Office values at less than five pounds property deposited therein under bye-law 3 of these bye-laws, he shall—

(a) re-deliver it to the owner if it is claimed by him within thirty days of its having been so deposited,

(b) if it is not so claimed, notify in writing the person who so deposited it that he may claim it within sixty days of its having been so deposited and, if that person so claims it, return it to him, or

(c) if it is claimed neither by the owner within the said period of thirty days nor, within the said period of sixty days, by the person who deposited it, deposit it in the Dublin Metropolitan Garda Divisional Stores where it shall be duly disposed of at the next following public sale held there.

6. Where the officer in charge of the Carriage Office values at five pounds or more than five pounds property deposited therein under bye-law 3 of these bye-laws, he shall—

(a) re-deliver it to the owner if it is claimed by him within ninety days of its having been so deposited,

(b) if it is not so claimed, notify in writing the person who so deposited it that he may claim it within one hundred and twenty days of its having been so deposited and, if that person so claims it, return it to him, or,

(c) if it is claimed neither by the owner within the said period of ninety days nor, within the said period of one hundred and twenty days, by the person who deposited it, deposit it in the Dublin Metropolitan Garda Divisional Stores where it shall be duly disposed of at the next following public sale held there.

7. The Dublin Street Service Vehicles (Lost Property) Bye-laws, 1959 ( S.I. No. 169 of 1959 ), are hereby revoked.

EXPLANATORY NOTE.

These bye-laws :—

(1) repeal the Dublin Street Service Vehicles (Lost Property) Bye-Laws, 1959;

(2) provide that whenever a passenger leaves property in a street service vehicle the driver of the vehicle shall within twenty-four hours (disregarding the period beginning on any Saturday at 5.30 p.m. and ending on the following Monday at 9.30 a.m.) either return it to the passenger or deposit it in the Carriage Office with the officer in charge of that office;

(3) provide that property deposited in the Carriage Office by the driver of a street service vehicle shall be re-delivered to the owner if it is claimed by him within a specified period;

(4) provide that property deposited in the Carriage Office and unclaimed by the owner shall be returned to the driver of the street service vehicle who deposited it if it is claimed by him within a specified period, and

(5) provide that property which is deposited in the Carriage Office, in accordance with the bye-laws, which is not claimed either by the owner or by the person who deposited it within a specified period shall be disposed of by public sale.
