SUGAR (REGULATION OF IMPORT) ORDER, 1962.

I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by section 2 of the Agricultural Products (Regulation of Import) Act, 1938 (No. 14 of 1938), hereby after consultation with the Minister for Finance and the Minister for Industry and Commerce, order as follows :—

1. (1) This Order may be cited as the Sugar (Regulation of Import) Order, 1962.

(2) This Order shall come into operation on the 1st day of January, 1963.

2. In this Order—

" the Minister " means the Minister for Agriculture;

" sugar " does not include—

(a) sugar not exceeding fourteen pounds in weight which is shown to the satisfaction of the Revenue Commissioners to be imported for the personal use of the person by whom it is imported or of his household, or

(b) sugar which is shown to the satisfaction of the Revenue Commissioners to be imported as a sample.

3. It shall not be lawful to import any sugar unless—

(a) the sugar is imported under and in accordance with a licence issued by the Minister under this Order, and

(b) the licence is delivered at the time of importation to the proper officer of Customs and Excise.

4. (1) The Minister may, whenever and so often as he thinks fit, issue a licence to import a specified quantity of any sugar.

(2) Whenever the Minister issues a licence under this Order, he may attach to the licence any one or more of the following conditions, that is to say :—

(a) a condition that the sugar to which the licence relates shall be of a specified description;

(b) a condition that such sugar shall be imported within a specified time or during a specified period;

(c) a condition that such sugar shall be imported from a specified country;

(d) a condition that such sugar shall have been manufactured or produced in a specified country;

(e) a condition that such sugar shall be imported at a specified port or place or by a specified route;

(f) a condition that such sugar shall be imported by or on behalf of a specified person;

(g) such other conditions as he thinks fit.

(3) The Minister may at any time revoke any licence issued under this Order.

5. Any person who imports or attempts to import any sugar in contravention of this Order, or who aids or abets the importation or attempted importation of any sugar in contravention of this Order, shall be guilty of an offence under this Order and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.

EXPLANATORY NOTE.

The effect of this Order is to prohibit as from 1st January, 1963 the import of sugar except under and in accordance with licences issued by the Minister for Agriculture.
