ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) REGULATIONS, 1962

The Minister for Local Government in exercise of the powers conferred on him by section 12 of the Roads Act, 1920 as extended by section 123 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations :—

1.—(1) These Regulations may be cited as the Roads Vehicles (Registration and Licensing) (Amendment) Regulations, 1962.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1960 shall be construed as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1962.

(3) These Regulations shall come into operation on the 1st day of May, 1962.

2. The Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) shall be amended as follows :—

(a) by the substitution for sub-article (4) of article 2 of the following sub-article :—

" (4) On application for a licence for a vehicle, the owner of the vehicle shall produce to the licensing authority—

(a) in the case of a pedestrian controlled vehicle which is excepted from Part VI of the Road Traffic Act, 1961 , a declaration that the vehicle is so excepted or

(b) in any other case, the relevant evidence of insurance in respect of the vehicle."

(b) by the substitution for sub-article (5) of article 2 of the following sub-article :—

" (5) In this article, the relevant evidence of insurance in respect of a vehicle means either—

(a) a certificate of insurance or a certificate of guarantee within the meaning of the Road Traffic Act, 1961 , showing that when the licence comes into operation there will be in force either an approved policy of insurance or an approved guarantee covering the use of the vehicle by the owner of the vehicle or by other persons on his order or with his consent, or

(b) such evidence as satisfies the licensing authority that the owner of the vehicle is either a vehicle insurer or a vehicle guarantor within the meaning of the Road Traffic Act, 1961 , or an exempted person within the meaning of Part VI of the Road Traffic Act, 1961 ."

EXPLANATORY NOTE

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958, so as to provide that an applicant for a licence for a pedestrian controlled vehicle which is excepted from Part VI of the Road Traffic Act, 1961 , which relates to compulsory insurance of vehicles, shall produce to the licensing authority a declaration that the vehicle is so excepted. In the case of any other vehicle the relevant evidence of insurance shall be produced.

The definition of " relevant evidence of insurance " is also amended so as to bring the definition into conformity with the provisions of Part VI of the Road Traffic Act, 1961 .
