BOVINE TUBERCULOSIS (ATTESTED AREA) (AMENDMENT) (NO. 2) ORDER, 1961.

I, PATRICK SMITH, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis and being satisfied that bovine tuberculosis is virtually non-existent in such area as consists of the administrative county of Clare and those parts of the administrative county of Limerick and the county borough of Limerick lying north of the River Shannon, do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), as amended by section 5 of the Diseases of Animals Act, 1960 (No. 26 of 1960), order as follows :

1.—(1) This Order may be cited as the Bovine Tuberculosis (Attested Area) (Amendment) (No. 2) Order, 1961.

(2) This Order shall come into operation on the 4th day of February, 1961.

2. In this Order "the Principal Order" means the Bovine Tuberculosis (Attested Area) Order, 1960 ( S.I. No. 236 of 1960 ).

3. Article 3 of the Principal Order, as amended by Article 3 of the Bovine Tuberculosis (Attested Area) (Amendment) Order, 1961 ( S.I. No. 9 of 1961 ), is hereby further amended by the insertion of "and the administrative county of Clare and those parts of the administrative county of Limerick and the county borough of Limerick lying north of the River Shannon" after "Sligo".

4.—(1) In the definition of "the area" contained in Article 2 of the Bovine Tuberculosis (Clearance Area) (Special Controls) Order, 1960 ( S.I. No. 178 of 1960 ), as amended by the Orders specified in the next paragraph, "as consists of the administrative counties of Leitrim and Roscommon and that part of the administrative county of Westmeath lying west of the River Shannon" is hereby substituted for all the words after "such area".

(2) The Orders referred to in the foregoing paragraph are the Bovine Tuberculosis (Clearance Area) (Special Controls) (Amendment) Order, 1960 ( S.I. No. 218 of 1960 ), the Principal Order and the Bovine Tuberculosis (Attested Area) (Amendment) Order, 1961 ( S.I. No. 9 of 1961 ).

5.—(1) In the definition of "the area" contained in Article 3 of the Bovine Tuberculosis (Clearance Area) (No. 1) Order, 1958 ( S.I. No. 78 of 1958 ), as amended by the Orders specified in the next paragraph, "Clare", is hereby deleted.

(2) The Orders referred to in the foregoing paragraphs are the Principal Order and the Bovine Tuberculosis (Attested Area) (Amendment) Order, 1961.

6. The Bovine Tuberculosis (Clearance Area) (Limerick) Order, 1959 ( S.I. No. 190 of 1959 ), and the Bovine Tuberculosis (Clearance Area) (Limerick) Order, 1960 ( S.I. No. 181 of 1960 ), are hereby revoked.

EXPLANATORY NOTE.

This Order, by extending the provisions of the Bovine Tuberculosis (Attested Area) Order, 1960, declares the administrative county of Clare and those parts of the administrative county of Limerick and the county borough of Limerick lying north of the River Shannon to be an Attested Area, i.e. an area in which the Minister is satisfied that bovine tuberculosis is virtually non-existent, with effect from 4th February, 1961. It also (1) provides for compulsory tuberculin testing of cattle in the area in certain circumstances and prohibits testing, except with the permission of the Minister, (2) prohibits movement of cattle into the area, except under permit and specifies the classes of cattle for which such permits shall be granted, (3) regulates movement of cattle into and out of herds, (4) controls public sales of cattle in the area and (5) provides for the disposal of reactors.
