Non-disclosure of information by the Board.

42.—(1) Subject to subsection (2) of this section, information obtained under section 40 or 41 of this Act or in the performance of the functions of the Board by the Board or a member, officer or servant thereof shall not be disclosed, without the consent of the person to whom or to whose business the information relates, to a person who is not a member of the Board or an officer or servant employed by the Board.

(2) Subsection (1) of this section shall not apply in relation to the disclosure of information to the Minister or the Comptroller and Auditor-General or for the purposes of any legal proceedings (whether civil or criminal) taken or proposed to be taken under this Act.

(3) A person who contravenes subsection (1) of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds.
