SOCIAL WELFARE (GENERAL BENEFIT) (AMENDMENT) REGULATIONS, 1960.

I, SEÁN MacENTEE, Minister for Social Welfare, in exercise of the powers conferred on me by sections 3 and 31 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby make the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (General Benefit) (Amendment) Regulations, 1960.

(2) The Social Welfare (General Benefit) Regulations, 1953 ( S.I. No. 16 of 1953 ), and these Regulations may be cited together as the Social Welfare (General Benefit) Regulations, 1953 and 1960.

2. In these Regulations "the Principal Regulations" means the Social Welfare (General Benefit) Regulations, 1953 ( S.I. No. 16 of 1953 ).

3. Sub-article (1) of article 3 of the Principal Regulations is hereby amended by the insertion after the definition of "the Act" of the following definition:—"' the Act of 1960' means the Social Welfare (Amendment) Act, 1960 (No. 25 of 1960);".

4. Article 5 of the Principal Regulations is hereby amended by—

(a) the insertion in paragraphs (b) and (c) of sub-article (3) after the words"widow's (contributory) pension (including any increase thereof)", where they occur, of the words "or old age (contributory) pension (including any increase thereof) or benefit under subsection (3) (inserted by section 8 of the Act of 1960) of section 26 of the Act,"

(b) the insertion in paragraph (a) of sub-article (5) before the words "disability benefit" of the words "an old age (contributory) pension which includes an increase, or".

5. Article 6 of the Principal Regulations is hereby amended by the insertion in sub-article (2) after the words "a maternity grant," and in sub-article (3) after the words "payment of", of the words "an old age (contributory) pension (including benefit under subsection (3) (inserted by section 8 of the Act of 1960) of section 26 of the Act),".

EXPLANATORY NOTE.

The Social Welfare (General Benefit) Regulations, 1953 ( S.I. No. 16 of 1953 ) specifies certain relaxations in the disqualifications imposed by the Social Welfare Act, 1952 , for receiving benefit for periods during which persons are imprisoned or detained in legal custody and provide for the suspension of payment of any benefit due, except in certain circumstances, during periods of such imprisonment or detention. These amending Regulations extend these relaxations and provisions for suspension to old age (contributory) pension (including benefit under subsection (3) of section 26 of the Social Welfare Act, 1952 ).
