IMPOSITION OF DUTIES (1V0. 94) (WATCHES) ORDER, 1960.

The Government, in exercise of the powers conferred on them by Section 1 of the Imposition of Duties Act, 1957 (No. 7 of 1957), hereby order as follows:

1. This Order may be cited as the Imposition of Duties (No. 94) (Watches) Order, 1960.

2. Paragraph 3 of and the First Schedule to the Imposition of Duties (No. 28) (Special Import Levies and Miscellaneous Customs Duties) Order, 1958 ( S.I. No. 92 of 1958 ), shall, as respects articles imported on or after the 2nd day of August, 1960, have effect as if—

(a) for the matter in column (2) of that Schedule at reference number 9 there were substituted the following:

"Watches and watch movements and assemblies of component parts of watches which assemblies incorporate the front and back plates or which incorporate a plate and one or more bridges",

(b) in column (3) of that Schedule at that reference number

"Whichever of the following rates produces in respect of each particular article the greater amount of duty, that is to say: 33 1/3% or thirty shillings the article" were substituted —for "60%",

(c) in column (4) of that Schedule at that reference number

"Whichever of the following rates produces in respect of each particular article the greater amount of duty, that is to say: 22 2/9% or twenty shillings the article" were substituted for "40%",

(d) for the matter in column (2) of that Schedule at reference number 10 there were substituted the following:

"Component parts and assemblies of component parts of watches excluding articles mentioned as chargeable with duty at reference number 9 in this Schedule".

(e) in column (3) of that Schedule at the said reference number 10 "Whichever of the following rates produces in respect of each particular article the greater amount of duty, that is to say: 33 1/3% or five shillings the article" were substituted for "60%",

(f) in column (4) of that Schedule at the said reference number 10 "Whichever of the following rates produces in respect of each particular article the greater amount of duty, that is to say: 22 2/9% or three shillings and fourpence the article" were substituted for "40%",

(g) in column (5) of that Schedule at the said reference number 10 the following provisions were inserted:

"Neither the duty mentioned at this reference number nor the duty mentioned at reference number 9 in this Schedule shall be charged or levied on component parts of watches or watch movements which are unassembled or which have been assembled only by pressing, soldering, welding, spinning, riveting or a similar process or a combination of such processes.

Whenever the Minister for Finance, after consultation with the Minister for Industry and Commerce, so thinks proper, the Revenue Commissioners may by licence authorise any particular person, subject to compliance with such conditions as they may think fit to impose, to import any article which is mentioned at this reference number or at reference number 9 in this Schedule and which was chargeable, immediately before the 2nd day of August, 1960, with the duty' mentioned at either of those reference numbers on payment of the duty chargeable thereon at a rate equivalent to the rate at which the duty chargeable thereon immediately before the 2nd day of August, 1960, was chargeable thereon immediately before that date, provided that—

(a) application for such licence is made to the Minister for Industry and Commerce on or before the 2nd day of September, 1960.

(b) it is shown to the satisfaction of the Minister for Industry and Commerce that the articles which are the subject of such application were in transit or on order immediately before the 2nd day of August, 1960, and

(c) the period of validity of any such licence does not exceed three months.",

(h) in column (1) of that Schedule immediately after "10" there were inserted "10A".

(i) in column (2) of that Schedule at reference number 10A (inserted by this paragraph) there were inserted "Watch cases and component parts thereof."

(j) in column (3) of that Schedule at the said reference number 10A (inserted by this paragraph) there were inserted "33 1/3 %",

(k) in column (4) of that Schedule at the said reference number 10A (inserted by this paragraph) there were inserted "22 2/9 %",

(l) in column (5) of that Schedule at the said reference number 10A (inserted by this paragraph) the following provision were inserted:

" The special manufacture licensing provision applies to the duty mentioned at this reference number.",

(m) in column (5) of that Schedule at reference number 21 ",10A" were inserted after "10" in the third provision.

EXPLANATORY NOTE.

The effect of the above Order is to reduce the ad valorem rate of Customs duty on watches and certain watch parts from 60% (full) 40% (U.K. and Canada) to 33 1/3% (full) 22 2/9% (U.K. and Canada) ad valorem and to provide for minimum specific duties of 30/- (full) 20/- (U.K. and Canada) per article on watches, watch movements and certain major assemblies of parts of watch movements and of 5/- (full) ¾d. (U.K. and Canada) per article on certain lesser assemblies of parts of watch movements. The Order also removes from Customs duty parts of watch movements which are unassembled or which have been assembled by certain processes.
