HOUSING OF THE WORKING CLASSES ACTS (FORMS) (AMENDMENT) ORDER, 1959.

The Minister for Local Government in exercise of the powers conferred on him by section 45 of the Housing (Miscellaneous Provisions) Act, 1931 , hereby makes the following regulations :—

1. These Regulations may be cited as the Housing of the Working Classes Acts (Forms) (Amendment) Order, 1959.

2. The Interpretation Act, 1937 , applies to these Regulations.

3. The forms described in the first column of the Schedule hereto (being forms prescribed by the Housing of the Working Classes Acts (Forms) Order, 1932) shall be amended in the manner set out in the second column of the Schedule hereto.

Amendment

Form No. 2

To the note at the foot of the form add the following paragraph:—

"Section 19A of the Housing (Miscellaneous Provision) Act, 1931 as inserted by section 21 of the Housing (Amendment) Act, 1958 provides that where a notice served under section 19 of the Housing (Miscellaneous Provisions) Act, 1931 has not been complied with and the house becomes vacant, it shall be an offence thereafter to use the house for human habitation or permit it to be so used and the offender shall be liable on summary conviction to a fine not exceeding £20 and to a further fine not exceeding £5 per day where the offence is continued after conviction."

Forms No. 6, 7 and 8

To the sub-paragraph numbered (1) in the second paragraph of Form No. 6 and in the final paragraph of Form No. 7 and to sub-paragraph (a) of the first paragraph of Form No. 8 add the following:—

"†and within     days after the expiration of the last-mentioned period be secured by the owner or owners against re-occupation.†"

To the footnote at the end of each form add

"†.....................† Delete if not required."

Amendment

Form No. 6

Amend the citation of section 23 of the Housing (Miscellaneous Provisions) Act, 1931 , contained in the note at the foot of the form by:—

(a) the insertion after "shall serve" in sub-section (3) of "a copy of";

(b) the addition of the following sub-section:—

"(4) A demolition order made under the last preceding subsection may require that the house to which it applies shall, within a period to be specified in the order, be secured by the owner or owners against re-occupation."

Add the following paragraph to the note:—

"Section 26 (4) of the Housing (Miscellaneous Provision) Act, 1931 as inserted by subsection (2) of section 22 of the Housing (Amendment) Act, 1958 provides that where a demolition order which contains a requisition under section 23 (4) becomes operative, the owner or owners of the house to which it applies shall, within the time limited in that behalf by the order, secure the house against re-occupation within that time, the local authority shall enter and secure the house against re-occupation and may recover the expenses from the owner or owners."

Forms Nos. 10 and 11

After "let" wherever that word occurs in the forms and in the note to Form No. 10 insert "or used."

EXPLANATORY NOTE.

The effect of these regulations is to amend certain forms prescribed by the Housing of the Working Classes Acts (Forms) Order, 1932, to be used in connection with the powers and duties of a local authority under the Housing of the Working Classes Acts, 1890 to 1931, which amendments are necessary to adapt these forms consequent on the amendments of the Housing (Miscellaneous Provisions) Act, 1931 effected by sections 21 , 22 and 23 of the Housing (Amendment) Act, 1958 .
