S.I. No. 176/1958 - Garda Síochána (Appointments) Regulations, 1958.


I, OSCAR TRAYNOR, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and section 1 of the Garda Síochána Act, 1958 (No. 14 of 1958), hereby, with the approval of the Government, make the following regulations :

1.—(1) These Regulations may be cited as the Garda Síochána (Appointments) Regulations, 1958.

(2) The Garda Síochána (Appointments) Regulations, 1945 to 1956, and these Regulations may be cited together as the Garda Síochána (Appointments) Regulations, 1945 to 1958.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

" the Commissioner " means the Commissioner of the Garda Síochána ;

" the Principal Regulations " means the Garda Síochána (Appointments) Regulations, 1945 ( S. R. & O. No. 173 of 1945 ), as amended.

4. Subject to Articles 5, 6, 7, 8 and 9 of the Principal Regulations, the Commissioner shall not appoint a woman to be a member of the Garda Siochana unless—

(a) the Commissioner is satisfied that she is unmarried or a widow and is of good character, and

(b) she is certified by the Surgeon of the Garda Síochána to be not less than five feet six inches in height and to be in good health, of sound constitution and fitted physically and mentally to perform the duties of a member of the Garda Síochána, and

(c) she has been selected by the Civil Service Commissioners on the results of a competition which shall include such tests as the Civil Service Commissioners, after consultation with the Commissioner, shall determine, and

(d) the Commissioner is satisfied that she had, on the 1st day of January in the year in which the competition commences, attained the age of twenty years but not attained the age of twenty-five years.

5.—(1) Article 4 of the Principal Regulations shall not apply in relation to the appointment and enrolling of a woman to be a member of the Garda Síochána.

(2) Articles 5, 6 and 7 of the Principal Regulations shall, in their application to a woman, have effect as if the references therein to Article 4 of those Regulations were references to Article 4 of these Regulations.
