TRANSPORT ACT, 1958 (MARKETS AND FAIRS) ORDER, 1958.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (2) of section 27 of the Transport Act, 1958 (No. 19 of 1958), hereby order as follows :

1. This Order may be cited as the Transport Act, 1958 (Markets and Fairs) Order, 1958.

2.—(1) The following markets and fairs are hereby specified for the purposes of section 27 of the Transport Act, 1958 (No. 19 of 1958), namely—

(a) every market established pursuant to section 103 of the Public Health (Ireland) Act, 1878,

(b) every market and fair established pursuant to a local or private enactment,

(c) every market and fair established under charter,

which is wholly or mainly for sale and purchase of livestock.

(2) In this Article " charter " has the same meaning as it has in the Executive Powers (Consequential Provisions) Act, 1937 (No. 20 of 1937).

EXPLANATORY NOTE.

This instrument specifies the classes of markets and fairs to or from which a farmer, not the holder of a merchandise licence, may, in the circumstances and under the conditions set out in detail in section 27 (1) of the Transport Act, 1958 , carry livestock from or to farms for reward for his neighbours by means of an agricultural tractor and trailer.
