DISEASES OF ANIMALS (LICENSING OF PIG DEALERS) ORDER, 1957.

I, SEÁN MOYLAN, Minister for Agriculture, in exercise of the powers conferred on me by the Agriculture Acts, 1931 to 1955, and the Diseases of Animals Acts, 1894 to 1957, hereby order as follows :

1. This Order may be cited as the Diseases of Animals (Licensing of Pig Dealers) Order, 1957.

2. This Order shall come into operation on the 11th day of November, 1957.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order—

" inspector " means a Veterinary Inspector of the Minister or a local authority ;

" the Minister " means the Minister for Agriculture ;

" pig dealer " means a person by whom or on whose behalf pigs are purchased habitually or from time to time for quick resale ;

" pig dealer's licence " means a licence granted under paragraph (1) of Article 6 of this Order.

5. Pigs shall not be moved by or on behalf of a pig dealer unless he is the holder of a pig dealer's licence.

6.—(1) The Minister may, in his absolute discretion, grant or refuse to grant to a pig dealer a pig dealer's licence.

(2) The Minister may from time to time attach to a pig dealer's licence such conditions as he thinks proper, and may revoke or amend any condition.

(3) The holder of a pig dealer's licence shall comply with any conditions attached to the licence.

7.—(1) Subject to paragraph (2) of this Article, the Minister may, in his absolute discretion, revoke a pig dealer's licence.

(2) The Minister shall give notice of his intention to revoke a licence to the holder thereof and shall, if representations are made to him within seven days, by the holder, consider such representations.

8.—(1) Application for a pig dealer's licence shall be made in writing in the form set out in the Schedule hereto.

(2) The application shall be delivered to the member in charge of the Gárda Síochána station nearest to the residence or premises of the applicant.

(3) The member in charge shall, where appropriate, sign the certificate attached to the application and forward the application to the Department of Agriculture, Dublin.

9.—(1) An Inspector or a member of the Gárda Síochána may at all reasonable times enter and inspect any premises where pigs are kept.

(2) The owner or person in charge of the premises shall produce, at the request of the inspector or member, any pig dealer's licence and any records kept pursuant to a condition of the licence and permit the inspector or member to inspect the licence and the records and take extracts from the records and give to him any information which he may reasonably require with regard to any entries in the records.

10. An inspector or a member of the Gárda Síochána may stop any vehicle suspected to contain pigs and the person in charge of such vehicle shall give to the inspector or member any information he may reasonably require with regard to the consignor and consignee of any pigs found therein and the places to and from which they are being carried.

11.—(1) Where pigs are being moved in contravention of a provision of this Order a member of the Gárda Síochána may direct the owner or person in charge of the pigs to move them to any place or premises specified by the member.

(2) A direction under paragraph (1) of this Article shall be complied with by the person to whom it is given.

Explanatory Note.

This Order defines a pig dealer as a person by whom or on whose behalf pigs are purchased habitually, or from time to time, for quick resale and prohibits the movement of pigs by or on behalf of such a person unless he is the holder of a pig dealer's licence.
