BACON EXPORT SUBSIDY (No. 3) ORDER, 1957.

In exercise of the powers conferred on them by Section 40 of the Pigs and Bacon (Amendment) Act, 1939 (No. 35 of 1939) and Section 13 of the Pigs and Bacon (Amendment) Act, 1956 (No. 37 of 1956) and with the concurrence of the Minister for Agriculture the Pigs and Bacon Commission hereby orders as follows :—

1. This Order may be cited as the Bacon Export Subsidy (No. 3) Order, 1957.

2. This Order shall apply only to bacon exported by a Licensee which was produced on the premises to which the Licensee's licence relates. For the purpose of this Order the bacon to which the Order applies shall be divided into two Classes—

Class I shall mean bacon exported to Great Britain or Northern Ireland of the quality and description defined in Clause 3 hereof as being of Grade " A " standard.

Class II shall mean all other exported bacon not falling within Class I.

3. In this Order " Bacon of Grade ` A ' Standard " means—

(a) Wiltshire sides cut and trimmed according to good trade practice, of an ex-factory net weight of not less than 48 lbs. and not more than 65 lbs. of a quality and in a condition suitable for the best retail trade, and conforming to the following measurements of the exterior back fat including rind, viz. :

Point of Measurement.

Maximum Measurement.

(i) Where the back fat is widest on the shoulder

2 inches.

(ii) At the top of the muscle which curves out over the loin into the fat

1 and 3/16th inches.

(iii) The centre of the middle (i.e. midway between points i and ii) and for seven centimetres on either side of the point of measurement

1 and 3/16th inches.

Minimum Measurement.

(iv) The centre of the middle (as at iii above)

¾th inch

(b) Backs, Middles, Shoulderless Sides or Spencers (Gammon-less Sides) cut and trimmed according to good trade practice, of a quality and in a condition suitable for the best retail trade and derived from the carcases of Grade " A " Pigs as defined in the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (No. 2) Order, 1955, as amended by Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (Amendment) (No. 1) Order, 1956.

4. Subject as hereinafter provided every Licensee who exports bacon of any Class to which this Order applies shall be paid a subsidy at the rate hereinafter specified appropriate to bacon of such Class.

5. (a) In respect of Class I bacon the subsidy shall be at the rate of 73/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 22nd April, 1957, and not later than the 27th April, 1957 ; at the rate of 60/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 29th April, 1957, and not later than the 4th May, 1957 ; at the rate of 47/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 6th May, 1957, and not later than the 11th May, 1957 ; at the rate of 23/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 13th May, 1957, and not later than the 25th May, 1957 ; at the rate of 13/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 27th May, 1957, and not later than the 15th June, 1957 ; at the rate of 3/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 17th June, 1957, and not later than the 6th July, 1957 ; at the rate of 13/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 8th July, 1957, and not later than the 13th July, 1957 ; at the rate of 19/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 15th July, 1957, and not later than the 20th July, 1957 ; at the rate of 35/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 22nd July, 1957, and not later than the 27th July, 1957 ; and at the rate of 51/- per cwt. on the net quantity arriving at a British port or at a point across the Land Frontier on and after the 29th July, 1957, and not later than the 8th August, 1957.

(b) In respect of Class II bacon the subsidy shall be at the nominal rate of 1d. per cwt. on the net quantity exported on or after the 22nd April, 1957, but no subsidy shall be payable in respect of bacon of this class exported on or after the 23rd April, 1957.

(c) For the purpose of this Order the net quantity exported shall mean the net weight of bacon dispatched from the Licensee's premises less an allowance of 1 per cent. for shrinkage.

6. Bacon shall not be deemed to have been exported until such time as it shall have been cleared by the Customs Authorities at the point of entry into Great Britain or Northern Ireland.

7. Payment of the subsidy will be subject to compliance by the Licensee with such conditions as may be contained in Regulations made by the Commission.

8. This Order shall be deemed to have come into force on Monday, the 22nd day of April, 1957.

9. Unless a contrary intention is indicated by the context all words and expressions used in this Order shall be construed as in the Pigs and Bacon Acts, 1935 to 1956.

10. The Bacon Export Subsidy (No. 2) Order, 1957, is hereby revoked and shall be deemed to have been revoked on the date when this Order shall be deemed to have come into force.

Explanatory Note.

This Order fixes the rates of subsidy payable to licensed bacon curers on bacon exported during the period from 22nd April, 1957, to 8th August, 1957, inclusive.
