MILK AND DAIRIES (TEMPORARY SPECIAL DESIGNATION LICENCE) REGULATIONS, 1957.

I, SEÁN MOYLAN, Minister for Agriculture, in exercise of the powers conferred on me by Section 14 of the Milk and Dairies (Amendment) Act, 1956 (No. 42 of 1956), hereby make the following regulations :

1. These Regulations may be cited as the Milk and Dairies (Temporary Special Designation Licence) Regulations, 1957.

2. These Regulations shall come into operation on the 30th day of July, 1957.

3. (1) In this Article " temporary licence " means a special designation licence granted under Part IV of the Milk and Dairies Act, 1935 (No. 22 of 1935), in respect of which the provisions specified in section 14 of the Milk and Dairies (Amendment) Act, 1956 (No. 42 of 1956), apply.

(2) In the application of the Milk and Dairies (Special Designations) Regulations, 1938 to 1955, in relation to a temporary licence, the following modifications of the Milk and Dairies (Special Designations) Regulations, 1938 ( S. R. & O. No. 148 of 1938 ), shall have effect, that is to say :

(a) in article 3 the following definition shall be substituted for the definition of " Licence " :

" ' Licence ' means a special designation licence granted under Part IV of the Act in respect of which the provisions specified in section 14 of the Milk and Dairies (Amendment) Act, 1956 (No. 42 of 1956), apply.",

(b) Articles 18, 22, 27, 28 and 29 shall not apply and the following Article shall be inserted after Article 29 :

" 29A. (1) A licence shall specify the date on which it comes into force, the date on which it expires and the area or areas in which the holder thereof is licensed to sell for human consumption under the special designation ' Pasteurised Milk ', milk which has been pasteurised by such holder.

(2) A licence shall (unless previously revoked or suspended) be in force for such period only as is specified therein and shall operate to license the holder thereof to sell for human consumption, in the area or areas specified therein but not elsewhere, under the special designation ' Pasteurised Milk ', milk which has been pasteurised by such holder.", and

(c) in Part III of the Second Schedule thereto—

(i) the following paragraph shall be substituted for paragraph (b) of condition 1, that is to say :

" (b) The milk shall be heated to a temperature not less than 180° Fahrenheit and an indicating thermometer shall be inserted in a suitable part of the apparatus during the whole of the process.",

(ii) condition 5 shall not apply,

(iii) the following paragraph shall be substituted for paragraph (a) of condition 7, that is to say :

" (a) An identification mark specified by the Minister for Agriculture in respect of the licence.", and

(iv) paragraph (b) of the said condition 7 shall not apply.

Explanatory Note.

The effect of these Regulations is to prescribe the modifications subject to which the Milk and Dairies (Special Designations) Regulations, 1938 to 1955, shall apply in relation to temporary special designation licences granted to creameries for the sale of milk under the special designation " Pasteurised Milk ".
