AGRICULTURAL PRODUCE (CEREALS) ACT, 1938 (SECTION 10) (EXEMPTION) ORDER, 1957.

I, WILLIAM NORTON, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (2) of section 10 of the Agricultural Produce (Cereals) Act, 1938 (No. 16 of 1938), hereby order as follows :

1.—(1) This Order may be cited as the Agricultural Produce (Cereals) Act, 1938 (Section 10) (Exemption) Order, 1957.

(2) This Order shall come into operation on the 26th day of February, 1957.

2. There is hereby exempted from the operation of subsection (1) of section 10 of the Agricultural Produce (Cereals) Act, 1938 (No. 16 of 1938), prepared foods (of the kind commonly known as breakfast foods) which are obtained by the swelling or roasting of wheat or wheaten products, whether or not containing other ingredients and whether or not they have undergone additional processes of preparation, but excluding preparations intended primarily for consumption by infants or invalids.

EXPLANATORY NOTE

Subsection (1) of section 10 of the Agricultural Produce (Cereals) Act, 1938 provides that it shall not be lawful for any person to import any commodity in the preparation of which wheat or any product of wheat is used unless such commodity is imported under and in accordance with a licence granted by the Minister. The effect of this Order is to exempt from such provision wheaten breakfast foods excluding preparations intended primarily for consumption by infants or invalids.
