TOBACCOS (MAXIMUM PRICES) ORDER, 1956.

I, WILLIAM NORTON, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939) as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :—

1.—(1) This Order may be cited as the Tobaccos (Maximum Prices) Order, 1956.

(2) This Order shall come into operation on the 14th day of May, 1956.

2. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. In this Order the words " Plug," " Coil," " Roll," " Twist," " Pigtail," and " Chewing " and the expressions " Cut Plug " and " Long Square " shall have the meanings attached to them by custom in the trade.

4. No person shall sell any brand or description of tobacco mentioned in the Schedule hereto at any reference number otherwise than by weight.

5.—(1) No person shall sell any brand or description of tobacco mentioned in Part I of the Schedule hereto at any reference number at a price exceeding a price calculated at—

(a) if sold under the conditions set out at the head of column (4) of the appropriate Part of the said Schedule, the rate set out in the said column (4) at the said reference number ;

(b) if sold otherwise than as set out at the head of column (4) of the appropriate Part of the said Schedule, the rate set out in column (5) of the said appropriate Part at the said reference number.

(2) No person shall sell any brand or description of tobacco mentioned in Part II of the Schedule hereto at any reference number at a price exceeding a price calculated at the rate set out in the appropriate Part of the said Schedule at the said reference number.

6. For the purpose of this Order fractions of one halfpenny shall be regarded as one halfpenny.

7. The Tobaccos (Maximum Prices) Order, 1955 ( S.I. No. 208 of 1955 ) is hereby revoked.

EXPLANATORY NOTE.

This instrument fixes new maximum retail prices for tobaccos, following on the increase of 7s. 11d. per lb. in the duty on tobacco.
