TEMPORARY CLOSING OF ROADS REGULATIONS, 1956.

The Minister for Local Government in exercise of the powers conferred on him by sections 4 and 35 of the Local Government Act, 1955 (No. 9 of 1955) and of every other power enabling him in this behalf hereby makes the following Regulations :—

1. These Regulations may be cited as the Temporary Closing of Roads Regulations, 1956.

2. These Regulations shall come into operation on the first day of March, 1956.

3.—(1) Before deciding to close a road, a local authority shall, save as is provided in Article 5 hereof, give notice of their intention to close the road—

(a) by notice in writing to the Minister ;

(b) by advertisement published in one or more than one newspaper, of which one shall be a daily newspaper, circulating in the functional area of the local authority and

(c) where the local authority intend to permit the holding of a road race or similar event on the road during the period for which it is to be closed, by notice in writing to the chief superintendent of the Garda Siochana within whose district the road is situate.

(2) The notices required to be given by this article shall be given at least fourteen days before the commencement of the period for which the road is to be closed and at such time as will allow an interval of at least seven days between the decision to close the road and the commencement of the said period.

(3) The notices required to be given by this article shall—

(a) describe the road which it is intended to close,

(b) state the period for which the road is to be closed,

(c) give particulars of any alternative route which will be available for public traffic,

(d) where the local authority intend to permit the holding of a road race or similar event on the road, state so and

(e) as respects the advertisement in a newspaper, specify a period, not being less than three days or more than seven days after the publication of the newspaper, within which any person interested may lodge with the local authority an objection to the closing of the road.

4.—(1) Save as is provided by Article 5 of these Regulations, a local authority shall give notice of every decision to close a road to the Minister and by advertisement in the newspaper or newspapers in which notice of their intention to close the road was advertised.

(2) Where the local authority intend to permit the holding of a road race or similar event on the road during the period for which it is to be closed, they shall give notice of the decision to close the road to the chief superintendent of the Garda Síochána within whose district the road is situate.

5. Where in the opinion of the local authority it is necessary as a matter of urgency to close a road for a period to public traffic and it is not intended to permit the holding of a road race or similar event thereon during the said period, the only notice required to be given by the local authority before closing the road shall be a notice in writing to the Minister describing the road which it is intended to close, stating the period for which the road is to be closed and giving the reason for the proposed closing and particulars of any alternative route which will be available for public traffic.

6. Where the Minister annuls or varies any decision or order made by a local authority to close a road, the local authority shall give public notice of such annulment or variation in the newspaper or newspapers in which notice of their intention to close the road was advertised.

7. The notices required to be given by Articles 4 and 6 of these Regulations may consist of a summary of the decision of the local authority or order of the Minister.
