CONTROL OF EXPORTS ORDER, 1954.

I, WILLIAM NORTON, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942. (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ), hereby order as follows :—

1.—(1) This Order may be cited as the Control of Exports Order, 1954.

(2) This Order shall come into operation on the 13th day of September, 1954.

2. In this Order—

" controlled articles " means—

(a) articles specified in Part I of the First Schedule to this Order, and

(b) articles specified in Part II of the First Schedule to this Order, not being articles specified in Part III of that Schedule ;

" export " includes the exportation of articles brought into the State for transhipment, whether under bond or otherwise ;

" appropriate officer " means, in the case of articles being exported by parcel post, an officer of the Minister for Posts and Telegraphs and, in any other case, the proper officer of Customs and Excise.

3. A person shall not—

(a) export any articles specified in Part I of the First Schedule to this Order,

(b) export to any place, other than Great Britain or Northern Ireland, any articles specified in Part II of the First Schedule to this Order, not being articles specified in Part III of that Schedule,

unless the articles are exported under and in accordance with a licence under this Order, and the licence is delivered to the appropriate officer before the exportation.

4.—(1) A Minister may, whenever and so often as he thinks fit, issue a licence to export any controlled articles of a particular description with or without limitation as to quantity, number or value.

(2) Whenever a Minister issues a licence under this Order, he may attach to the licence any one or more of the following conditions.

(a) a condition that the controlled articles to which the licence relates shall be exported within a specified time or during a specified period,

(b) a condition that such articles shall be exported at a specified port or place or by a specified route,

(c) a condition that such articles shall not be exported in more than a specified number of consignments.

(d) a condition that such articles shall be exported by a specified person,

(e) a condition that such articles shall be consigned to a specified consignee,

(f) such other conditions as such Minister thinks fit.

(3) Licences under the Control of Export Order, 1953 ( S.I. No. 226 of 1953 ), which were in force immediately before the commencement of this Order shall continue in force as if they were licences under this Order.

5. This Order shall not apply to the exportation of controlled articles as respects which the appropriate officer is satisfied that such articles—

(a) are being exported for repair and return,

(b) are travellers' samples being exported after being imported temporarily,

(c) are travellers' samples being exported temporarily to be subsequently re-imported,

(d) are being re-exported to the country from which they were imported as a result of being refused by the consignees, or

(e) are used containers of any material or description which are being re-exported empty to the sender.

6. Where any articles specified in Part II of the First Schedule to this Order, not being articles specified in Part III of that Schedule, are entered for export to Great Britain or Northern Ireland, no person shall deliver, or cause, procure or facilitate in any manner the delivery of, such articles at any destination other than a destination in Great Britain or Northern Ireland, as the case may be.

7. Nothing in this Order shall be construed as affecting in any way the operation of any Act (whether passed before or after the commencement of this Order), or any instrument made (whether before or after the commencement of this Order) by virtue of such Act, which authorises and provides for the control, regulation restriction or prohibition of the export of any articles.

8. The Orders specified in the Second Schedule to this Order are hereby revoked.

FIRST SCHEDULE.

PART I.

ARTICLES THE EXPORT OF WHICH IS CONTROLLED TO ALL PLACES.

Aluminium scrap.

Cement.

Fertilisers.

Hides of cattle and horses and pieces of such hides.

Horns and hooves of cattle.

Leather.

Machinery as follows :—

Crawler tractors, excavators, drainage ploughs.

Sheep or lamb pelts from which the wool has been removed (whether processed or not) and pieces thereof.

Sheepskin pieces.

Ships, other than vessels under fifteen tons gross weight and fishing boats.

The following commodities which are made from sugar or other sweetening matter or to which sugar or other sweetening matter has been added in the course of preparation except when exported by parcel post :—

sweets and chocolates, chocolate couverture, mixtures containing creamery butter.

Tea.

Waste Paper.

Wheat products as follows :—

commodities in the preparation of which wheat or any product of wheat is used, other than commodities to which sugar or other sweetening matter has been added in the course of preparation.

Wood and timber (not including cork or fully constructed articles of timber).

PART II.

ARTICLES THE EXPORT OF WHICH IS CONTROLLED TO PLACES OTHER THAN GREAT BRITAIN AND NORTHERN IRELAND.

Abrasives of silicon carbide and boron carbide.

Arms, ammunition and military and naval stores.

Asbestos.

Carbon black.

Chemicals and drugs.

Coke and coke flour derived from petroleum and coal tar pitch.

Core drill bits.

Crucibles of artificial graphite.

Diamonds for industrial use.

Electrical goods and apparatus.

Glass-ware, scientific.

Graphite, artificial, amorphous carbon and carbon powder.

Iron and steel and manufactures thereof.

Machinery and parts.

Magnesium silicate (steatite).

Mica slabs, sheet and splittings.

Military type jigs, fixtures and plate metal working accessories.

Non-ferrous ores, metals and manufactures thereof.

Oil seeds, oils, fats, resins, gums and manufactures thereof.

Paper or synthetic film for dielectric use (condenser tissue) coated or uncoated 0.0015 inch (0.038 mm.) or less in thickness.

Refractory materials and products.

Rubber and rubber manufactures as follows :—

tyres, tyre casings, inner tubes, high-pressure rotary drilling hose, meteorological balloons and water lubricated bearings.

Scientific instruments and apparatus.

Tools (including dies and slugs) incorporating diamonds.

Vehicles (including locomotives, tractors and aircraft).

Vessels under fifteen tons gross weight and fishing boats.

PART III.

ARTICLES EXCEPTED FROM LIST OF ARTICLES SET OUT IN PART II.

Appliances, apparatus, accessories and requisites (including gaming machines) for sports, games, gymnastics or athletics.

Appliances, equipment, utensils (including cooking, heating, washing and cleaning apparatus) suitable only for domestic use.

Beads.

Belldomes and gongs.

Binoculars.

Book-ends.

Brooms and Brushes.

Buttons.

Candles.

Church furniture and Church requisites.

Cigar and cigarette cases and boxes and articles of which such cases or boxes form part.

Cigar and cigarette holders.

Clocks and watches.

Combs.

Chemicals as follows :

Cosmetics, detergents, disinfectants, fungicides, glycerine (crude), gypsum, hair lotion, insecticides, ochre, perfumery, rat poisons, sheep dips, weed-killers, dyes and colours, menthol.

Machinery and parts as follows :

Agricultural and horticultural machinery, concrete block making machines, and office machines.

Manicure sets.

Manufactures of oils or fats, being manufactures to which sugar or other sweetening matter has been added in the course of manufacture.

Manufactures of silver, electro-plate and nickel silver.

Margarine.

Mechanical lighters.

Medicines and medicinal preparations.

Musical instruments and accessories therefor.

Nail cleaners, clippers, files and polishers.

Pipes for smoking tobacco and parts thereof.
