COUNTY KERRY VOCATIONAL EDUCATION COMMITTEE (SPECIAL PROVISION) (GAELTACHT) ORDER, 1953.

WHEREAS it is enacted by subsection (1) of section 103 of the Vocational Education Act, 1930 (No. 29 of 1930), that where a vocational education area or part of a vocational education area is included in the Gaeltacht and the Minister for Education is of opinion that, having regard to the conditions in such area or such part, it is essential that special provision should be made in relation to continuation education or technical education in such area or such part, he may make an order requiring the vocational education committee for such area to make such special provision in relation to continuation education or technical education in such area or such part as may be specified in such order, and it shall be the duty of such Committee to comply with the terms of such order:

AND WHEREAS part of the vocational education area of the County Kerry Vocational Education Committee is, by virtue of the Vocational Education (Gaeltacht) Order, 1933 (Statutory Rules and Orders, No. 85 of 1933), included in the Gaeltacht, and the Minister for Education is of opinion that, having regard to the conditions in such part, it is essential that special provision should be made in relation to continuation education and technical education in such part:

NOW, THEREFORE, I, SEÁN Ó MAOLÁIN, Minister for Education, in exercise of the powers conferred on me by subsection (1) of section 103 of the Vocational Education Act, 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling, do hereby order as follows:—

1. This Order may be cited as the County Kerry Vocational Education Committee (Special Provision) (Gaeltacht) Order, 1953.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

The expression " the Minister " means the Minister for Education ;

the expression " the Committee " means the County Kerry Vocational Education Committee ;

the expression " the Gaeltacht area " means the portion of the administrative county of Kerry specified in the Schedule to the Vocational Education (Gaeltacht) Order, 1933 (Statutory Rules and Orders No. 85 of 1933).

4.—(1) The Committee shall make the following special provisions in relation to continuation education and technical education in the Gaeltacht area, that is to say:—

(a) the Committee shall arrange for the permanent supply of courses of instruction in such subjects as, having regard to the special circumstances of the Gaeltacht area, may be required, and

(b) the Committee shall for the purposes of such courses employ a staff of duly qualified teachers and provide sufficient and suitable accommodation and equipment.

(2) Expenditure under this Article shall be included in every annual scheme of the Committee, and, if and when such scheme is approved by the Minister, shall be met as part of the expenditure in respect of such annual scheme.

5. Nothing in this Order shall be construed as affecting the duty of the Committee to make, in the exercise of its general powers in relation to continuation education and technical education, such provision throughout its entire vocational education area as, having regard to the moneys available for the Committee under section 43 (as amended by section 3 of the Vocational Education (Amendment) Act, 1936 (No. 50 of 1936) and by section 2 of the Vocational Education (Amendment) Act, 1950 (No. 33 of 1950), and section 53 of the Vocational Education Act, 1930 (No. 29 of 1930), the Minister may from time to time consider satisfactory.
