RIVER CLADY HYDRO-ELECTRIC SCHEME APPROVAL ORDER, 1953.

WHEREAS, under subsection (1) of section 4 of the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945), the Electricity Supply Board has submitted to the Minister for Industry and Commerce a scheme for the generation of electricity by means of hydraulic power derived from the waters of the River Clady :

AND WHEREAS the Minister has considered the said Scheme and has consulted with the Minister for Agriculture as to the steps to be taken by the said Board for the protection of fisheries :

NOW, I, SEAN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945), hereby order as follows :

1 Short Title

1. This Order may be cited as the River Clady Hydro Electric Scheme Approval Order, 1953.

2 Definitions

2. In this Order—

the expression " the Act " means the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945) ;

the expression " the Board " means the Electricity Supply Board ;

the expression " the scheduled Scheme " means the scheme set out in the Schedule hereto.

3 Approval of Scheme

3. The scheduled Scheme is hereby approved.

4 Places for deposit of maps, plans and books of reference

4. The stations of the Garda Síochána at Bunbeg and Dungloe, both in the County of Donegal, are hereby prescribed as the places at which (in addition to the head office of the Board in the City of Dublin) the maps, plans and books of reference in relation to the scheduled Scheme shall, in pursuance of subsection (4) of section 9 of the Act, be deposited by the Board.

5 Newspapers in which notice is to be given of deposit of maps, plans and books of reference

5. The Donegal Democrat, the Donegal Vindicator and The People's Press are hereby prescribed as the newspapers in which (in addition to two or more daily newspapers circulating in the City of Dublin) public notice by advertisement of the deposit of the maps, plans and books of reference in relation to the scheduled Scheme shall, in pursuance of subsection (5) of section 9 of the Act, be given by the Board.

6 Maximum advance

6. With the consent of the Minister for Finance, the sum of £620,000 is hereby prescribed as the maximum sum to be advanced under section 38 of the Act, as amended by section 2 of the Electricity (Supply) (Amendment) Act, 1952 (No. 4 of 1952), for the purpose of carrying out the scheduled Scheme.

SCHEDULE

Title of the Scheme

1. The Scheme may be cited as River Clady Hydro-Electric Scheme, 1953.

Nature and Location of the Scheme

2. The Scheme contemplates a development of the water power resources of the River Clady by regulating the levels of the waters in Dunlewy Lough and in Upper and Lower Loughs Nacung and diverting the flow derived therefrom of the River Clady through a head race canal to a generating station to be located on the North bank of the Gweedore River.

The plan attached hereto shows the location of works necessary for this development and the catchment area to be utilised.

Dunlewy Lough will have a storage high water level of 209 feet or thereby with provision for flood water level of 215 feet or thereby above Ordnance Datum. Upper and Lower Loughs Nacung will have a storage high water level of 202 feet or thereby with provision for flood water level of 207 feet or thereby above Ordnance Datum.

The Scheme is located in the townlands of Arduns, Ardnagappary, Bunbeg, Crolly, Cronaguiggy, Dore, Dunlewy Near, Dunlewy Far, Glentornan, Keeldrum Upper, Knockastoller, Magheraclogher, Meenacung, Meenderrygamph, Moneymore and Moneybeg, in the Barony of Kilmacrenan and in the townlands of Ardmeen, Bunawack, Crohyboyle, Derrynamansher, Killindarragh, Lettercau, Loughanure, Meenderrynasloe and Meenalecky, in the Barony of Boylagh, all in the County of Donegal.

Works

3. The works to be constructed for the purpose of the Scheme are :—

Work No. 1 :

A generating station in the townland of Dore on the North bank of the Gweedore River 3,815 feet or thereby in a westerly direction from Dore school and including a tail race to Gweedore River.

Work No. 2 :

An approach road to the generating station (Work No. 1) in the townlands of Dore and Crolly from a point on the public road Gweedore to Dungloe, 3,230 feet or thereby, in a south-westerly direction from Dore school.

Work No. 3 :

A pipe line in the townland of Dore extending from the westerly end of the canal (Work No. 4) to the generating station (Work No. 1).

Work No. 4 :

A canal in the townlands of Arduns and Dore 8,800 feet or thereby long extending from a point on the Clady River 590 feet or thereby in a south-easterly direction from Gweedore railway station to a point alongside the public road Dore school to Bunbeg 2,935 feet or thereby in a north-westerly direction from Dore school.

Work No. 5 :

A weir, with fish pass, across the River Clady and a canal intake in the townlands of Meenderrygamph and Arduns at a point on the River Clady 590 feet or thereby in a south-easterly direction from Gweedore Railway Station.

Work No. 6 :

Main road bridge and accommodation road bridges in the townlands of Arduns and Dore over the canal (Work No. 4) at points along the canal 650, 2,150 and 4,300 feet or thereby respectively in a south-easterly direction from the location of Work No. 5.

Work No. 7 :

A diversion in the townland of Meenderrygamph of the public road along the north bank of the River Clady between a point 4,840 feet or thereby measured in an easterly direction from Gweedore Railway Station to a point 220 feet or thereby measured in an easterly direction from the said Railway Station.

Work No. 8 :

A storage dam in the townlands of Moneybeg and Dunlewy Far, across the Cung between Dunlewy Lough and Lough Nacung Upper, and including spillway, regulating sluice, fishpass and road overbridge.

Work No. 9 :

A diversion in the townlands of Dunlewy Near and Dunlewy Far of the road from Dunlewy village to Dunlewy Castle.

Work No. 10 :

Such other works as may be agreed upon between the Minister for Agriculture and the Board to be necessary or desirable for the preservation or improvement of any fishery, fishing right, or fishing amenity, affected or likely to be affected, by the scheme.

Work No. 11 :

Such other works as may be found necessary in lieu of compensation and/or for the construction and complete and satisfactory operation of the scheme.

Lands

4. The plan attached hereto shows, coloured, the lands and houses thereon and that portion of the Burtonport extension of the L. & L. S. Railway which will be required to accommodate this scheme.

Waters to be Impounded

5. The waters to be impounded, abstracted, diverted and used for the purpose of the scheme are :

Lough Dunlewy,

River Clady,

Upper and Lower Loughs Nacung,

tributaries thereof,

provided, however, that there shall be discharged down the River Clady past the weir forming Work No. 5—

(i) sufficient water to ensure an average flow immediatley below the weir of 29,000 cubic metres or thereabouts a day throughout the year,

(ii) in addition freshets up to a total not exceeding 5½ million cubic metres in each year (including natural spates and counting one natural spate as one freshet) in such quantities and at such times as may be agreed between the Minister for Agriculture and the Board.

Capacity of Generating Station

6. The approximate capacity of the generating plant to be installed at the generating station is 4,000 kilowatts.

Cost of the Scheme

7. The cost of the works based on present day prices is estimated at £620,000, including compensation for lands, fisheries, etc., but excluding the cost of transmission lines from the generating station to points of demand.
